Okay, so in LA, a healthy chunk of Thai restaurants has waitresses working in them that have all come here on a student visa - despite the fact that most have never, or rarely, gone to the school they signed up for. There's enough of them here (in a small, non-representative sample I took), to warrant the question - how does the student visa process work? I assume it starts with them being enrolled in a Thai university of school, that is associated with some kind of exchange program for students. What universities qualify? What programs are there? What are the qualifications for students to qualify for the student exchange? Yeah, lots of questions, but this situation intrigues me, and I'm sure someone on here must know about it.

I have a friend in the UK that recruits 'students' from Shanghai. She represents a 'College' that charges the 'students' tuition and registers them in 'classes'. The student's request for a Student Visa is then endorsed by the 'College'. As long as the 'student' remains registered and pays tuition the students can pretty much do what they want to do. As for the US you do not have to be registered in a school in Thailand but according to the State Department Website you must have been accepted into a accredited US school, college, or university for either a study or research program. Student Visas Attendance in classes are mandatory and this is supposedly verified by Homeland Security. Hope this clears it up for you Duck...

Just like anywhere (getting an Ed visa here in Thailand, for instance), you need an acceptance from a real and certified school in the desired location. I'd always thought that those Thai in California were working on some kind of employment status visa--I'm sure such a thing exists, though I haven't really researched it---since most of those girls/women simply couldn't be admitted to most accredited schools there. I've met quite a few women going over there to work, and they are obviously weren't educated enough for that. Are they really mostly on student visas? I thought that would be difficult.

All the girls I talked to, which are usually half the waitresses in about a dozen different restaurants, are here on student visa. Invariably, registered for something like Pasadena City College, or some other similar City College. Usually on an English Language study program. As for China Sailor's response - yes, buddy, I can cut and paste too (or, read and regurgitate). That's not the question I asked, though.

You asked how the student visa process worked, I answered you. Now student exchange is different from student visa. For example when my son went to Germany on a Student exchange he was a visa-exemption as a tourist. The same was for the German student who came to visit us, he was a tourist. Student exchange is a program for limited term in which most cases the 'students' are on tourist visas. These exchanges are arranged between two schools and are facilitated by various private organizations such as The Council on International Student Exchange who arranged my son's program. As these exchange groups have one or more teachers with them I doubt that you will find them working in a restaurant in LA. Now if you had bothered to go to the link I provided you would have found this: Maintaining Immigration Status which forbids students from 'unauthorized employment'. However, this does not exclude them from part-time jobs within the rules of the school to which they attend. I would suggest Duck that these waitresses were working part-time on the approval of their schools. Next time Duck instead of criticizing try reading the links in the posts. The reason they are there is to keep the posts (and in turn BK's storage capabilities) manageable. But then again 'Foo don't want no help Foo don't get no help'...

Student Visa's in Aus stipulates minimum 20 hours study max 20 hour work,,,per week. Approval for work MUST be applied for AFTER arrival. Australia does NOT have slave labour wages as per the USA. God bless Australia. Mel

Zip in all of these cases. If any, the majority of these girls are dating Thai guys (didn't check if any of them had green cards either). Yes, a few of them ended up marrying locals, but the majority it seems was not after that.

DD, I know this process pretty well. The majority of them ended up here via Language Systems. Which is a school that preps them for the TOEFL and can issue them an I20. Once they have the I20 and a few of the DS forms, they can go to the embassy to apply for the F1 student visa. Getting the I20 does not mean that they can come here yet, but they need it for the interview. At the interview, they get asked a few questions but it's mainly a preqaul to see that they can survive here. The bank account is important, otherwise how can they pay for rent and school? To get Language Systems or another one of those BS schools to issue you an I20 usually is not hard. You just have to demonstrate that the student will have sufficient funding, I think Language Systems wants to see about 12k and it can come from any source. They issue these pretty easily with the hopes that the F1 gets issued and they get the tuition money. If not, there is just a small service fee that they charge in case you get rejected at the embassy. Language Systems is the most popular one because the classes are cheap and many people have gotten here using them. But word is at the embassy they blacklisted Language Systems or closely scrutinize the applicants going there. Still, I know of many people that are still coming through them. There are several other schools that are fairly cheap that offer similar courses. These schools do not care about attendance, so long as you pay tuition you can maintain your status. Once you stop paying, then they will report you. The students here on visa that go to a real school like a UC or Cal State are usually fairly wealthy as tuition is quite high. If you really want to get an F1 visa, what you do is you apply to a more expensive program such as a Cal America and then once you are here, you can transfer your I20 over to Language Systems and keep your tuition costs down. It betters your odds. Students here on F1 visa are NOT allowed to work. Hence they work under the table at restaurants. MOST of them just come here to earn some cash working and don't take the schooling seriously at all only to return after their Visas expire. Some actually work toward degrees but that is the exception. Most of them want to stay here in the US and some end up paying for faux marriages (about 25-30k going rate). Some of them go out with Thai guys with greencards, Thai guys w/o greencards, it's a mix. They seem to like Asian dudes that have greencards or citizenship the best. I'm close with the people here in Thaitown at least and it's this same story most of the time.
