I have read that for a non-Thai, it can take 2 million baht to start a business.  Is that true? Second, is it considerably cheaper with a thai partner?  If anyone can get a hold of this information I would appreciate it.

There are many different rules applying to different
kinds of business.

Best if you contact a lawyer and ask him advice.

In principal you have to setup business with several partners  and you can not own more than 49%.

But with some constructions you can make sole decisions.

The reference to 2 million Baht is to the minimum REGISTERED capital that it takes to support 1 farang for a Work Permit. 2 farang 4 million etc.

Registered capital has to do with the liability limitation of the corporation. PAID UP capital = registered capital that has actually been paid in by the (minimum 7) shareholders, initially the Paid Up capital needs to be at least 1/4 of the Registered capital (so 500,000 baht if there is a single farang who needs a work permit) and you have x-number of months (8 I think) to pay up the rest. That goes into the company bank account NOT to the government and yes it is working capital. And it can be in-kind (equipment etc) but your auditor might require valuation by the Bank of Thailand.

In general forming and owning a company is easy and straightforward. However, there are various pitfalls. If your premises are rented or leased you will need the cooperation of your landlord to effect VAT registration as the tabien bahn and the land title deed must be shown to the Dept of Commercial Registratioin and the lease contract must permit the presence of the corporation, or be in the name of the corporation.

As you are new, might I be so bold as to suggest that you slow down a bit in fully embracing the life/work in Thailand experience?  It can be veryt good but it's not always easy (Yes I know, that is true of every place).  I've seen more than a few people devoured by this place.
I used to work in a law office in Pattaya where a large part of thre business was advising and assisting falangs wha wanted to start a business here.  You're at the risk of sounding a bit like some of the people we would laugh at once they had left the office.  Take your time, remember that falangs have been coming here to settle down for a long time and that it's relatively few who can really achieve the life they imagined.

just curious, but anyone has any knowledge or experience on opening/running a fast-food franchise (starbuck's, krispee kreme, kfc, etc) in bkk?  do you have to go through the same govt hurdles/regulations?  any and all advice will be greatly appreciated.

That URL is the SCM law office. They are a moderately mysterious bunch, I am investigating them now since they offer some unique services that would, if the firm is legitimate, be of interest to me. So far I have determined that SCM stands for Siam Capital Management (Co.,Ltd) and so they are not principally a law firm, but some sort of finance company or credit foncier that does accounting and legal services on the side.

The broad brush legal non-advice they give on the website can be had from many online sources and may well have been copied from Baker & McKenzie or elsewhere.

When I find out if these guys are on the up and up I will post the info. At the moment I am a leetle skeptical of them since I called them and asked for a list of their attorneys on staff, and they refused to give it up.

That doesn't sound like a bona fide law firm to me. But we'll see.
