NLA agrees women can be jailed for rape

The National Legislative Assembly yesterday accepted in principle legal amendments to punish not only men but also women convicted of rape. The government proposed the amendment to article 276 of the Criminal Code, which now broadens punishment against rapists to cover female offenders as well as males, for the sake of ''gender equality'', according to the amendment draft.

Punishment is 4-20 years in jail and a fine of 8,000-40,000 baht.

Also altered was article 277, which now stipulates the same level of punishment for convicted male rapists whose victims are 15 years old or younger.

The government has proposed, however, that the article apply to female rapists as well.

Rape offenders who are still minors may avoid punishment if the court allows them to marry their victims with the consent of the victim or their parents.

Article 286 was also changed, allowing for punishment of people aged over 16 years who regularly benefit sexually or financially from one or more prostitutes. Proposed penalties are 7-20 years in jail, life imprisonment or a fine of 4,000-40,000 baht.

Also accepted in principle are proposed amendments to articles 1445, 1446 and 1447 of the Civil Code. The articles currently state that only men can demand compensation from people who have sex with or rape their fiancee.

The amendment will also enable women to claim such compensation. The demands must be made within five years of being aware of the violation.

The government, which sponsored the draft amendments, insisted the changes would serve gender equality and human dignity.

Thailand : Nod for law backing male rape victims

The National Legislative Assembly (NLA) yesterday accepted the principle of proposed legal amendments that will allow male rape victims to sue their abusers.

As part of the proposed amendments, cuckolded husbands will also be able to demand compensation from their wives' lovers, while an engaged person is entitled to receive compensation from other people who they have sex with, rape or attempt to rape his or her fiance.

The proposed legal amendments also said that anyone living off income from prostitution would be punished under criminal law, in a move that clearly targets pimps or procurers.

The NLA yesterday passed the resolution by an overwhelming majority to accept the proposed amendments in principle. However, the details of the draft laws prompted debate.

Justice Minister Charnchai Likhitjittha said the proposed amendments to the criminal code would make it an offence for individuals to rape a person who is not their wife or husband. Under current laws, a rapist is defined as someone who rapes a woman who is not his wife.

"I am not sure whether society will accept this change," NLA member Khunying Nantaka Supraphatanant said. She feared any such legal amendment could offend women given that it was a shame if women forced men to have sex with them.

Another NLA member, Tuang Anta-chai, also questioned what evidence could be used against the abuser. "If a man rapes a woman and then lodges a complaint that he is the victim, what evidence will the authorities use?" Tuang asked.

NLA member Wallop Tangkhananu-rak was concerned about the proposed punishments against those living off prostitutes' incomes. "I know that this proposal aims to target pimps. But what about the prostitutes' children?" he said.

NLA member Waemahadee Waeda-o said the fianc้e clause would affect Muslim men because they were allowed to have up to four wives.

Men may have hard time proving rape

It will be difficult, but not impossible, to prove a man's complaint that a woman raped him, according to police.

Earlier this week, the National Legislative Assembly approved in principle a proposal to amend the criminal code so that male rape victims would be able to sue their abusers. Current laws recognise rape complaints filed by female victims only.

National Police assistant commissioner Jongrak Juthanont yesterday said if the proposal became law, it would be investigators' duty to gather evidence when male victims lodge rape complaints.

"We can examine the alleged crime scene. We can check the physical conditions of the complainants and their alleged abusers. We can check if any clothes are ripped," Jongrak said.

As an example, he said it would be hard to believe if a big man accused a smaller woman of raping him. A young boy's complaint that fully grown women raped him, on the other hand, could have more grounds, he said.

Jongrak added that the relationship between the complainant and the alleged attacker would also be a key matter.

"We have to be very careful if the accused and the accuser have had a relationship," he said.

Pol Colonel Pornchai Sutheerakhun of the Forensic Medicine Institute said physical examinations could find evidence in men who were forced to have anal sex if the victims immediately went to doctors.

"Bruises on the complainants' bodies also count as evidence," he explained.

Pornchai was not confident about gathering evidence for a man's complaint that a woman raped him.

Meanwhile, Women's Affairs and Family Development Office deputy director Kingkeaw Insawang said the proposed legal amendment was intended to protect all rape victims, including boys, men and transsexuals.

The change focuses on a legal clause in the current criminal code, which now defines a rapist as someone who rapes a person who is not his wife.

Yes. Spousal "rape" charges are seldom proceeded with even in countries that have laws against it - at least whilst the parties are cohabitating that is. Too difficult to prove and there is always a high likelihood that the complainant will recant or if possible drop the charges, once the parties "kiss and make up". For practical reasons you'd be more likely to be charged with assault of some kind - same as she would be once she cuts your cock off later that night you raped her. Enjoy.

This is exactly what I dislike about Thailand. Lived in Japan for several years and much preferred their attitudes towards foreigners – no hiding behind a fake smile, if they did not like you they made it clear. Sure makes it easier to sort thru all the bullshit one encounters in Thailand.

This fake smile crap make me feel much more restrained rather getting a since of freedom. Any since for freedom that I have in LOS is due mainly to the fact that I have enough cash to get me out a difficult situation should I find myself in one.

I would hardly call hiding behind a fake smile a show of tolerance.

I much prefer the direct approach to all the childish games one encounters in Thailand. Then again I’m just a stupid Farang.

Beg to differ; I can truly say, with my hand on my heart, that p4p accounts for at most about 40% of all attractions that LOS has for me. Don’t like temples, but do like the general Thai attitude towards non Thais’. In Thailand one feels a great sense of freedom and tolerance which is absent in most other countries in the world. Thais will take one’s money, but at least they’ll smile and be gracious about it, unlike many other nationalities, who’ll not only take the money, but also snarl at one, during the process.




Like you can get that 40% at home? Anyway it does not matter if it is 40% or 100%, you still come for the P4P.
