Slightly off topic, but if anyone here can get me a Size S "Tiger beer" dress (For a present) before they are illegal I ll be glad to pay for it. Report from Bangkok Post dated Wednesday 25 October 2006 :- Drinking age in Thailand to be raised to 20 =============================== Thailand's Cabinet Tuesday decided to raise the threshold making the legal age for liquor consumption to be age 20 and to complete the process to enforce the new regulation along with the total ban on liquor commercials by November 2006. Public Health Minister Mongkol Na Songkhla said the Cabinet discussed the legal drinking age, which was originally pondered to be 25, and decided on 20 The Disease Control Department will work out details of the draft Alcoholic Beverage Consumption Control Act before seeking Cabinet approval. After Cabinet endorsement, the draft will be sent to the Council of State and the whole process which leads to enforcement of this new rule should be completed by November, according to Dr. Mongkol. Apart from setting the drinking age, the Cabinet also discussed complaints about the impact of the Food and Drug Administration's order banning liquor advertisements around the clock that will result in a Bt200 million revenue loss to the state. Dr. Mongkol said the Cabinet is of the view that advertising revenue from the alcoholic drink sector is neither significant nor sustainable. The Cabinet is pondering a possible solution in the form of increasing the so-called 'sin tax' – doubling the collection of "health promotion" duties on cigarettes and alcoholic beverages from the current rate of two per cent to four per cent. To address potential constraints in implementing the law, Dr. Mongkol said the Public Health Ministry will invite the private sector and all stakeholders to discuss enforcement.

Report from The Nation dated Friday 27 October 2006 :- FDA waters down ban on alcohol ads =========================== Agency decides to allow commercials without brand names or logos of products to give industry some leeway The Food and Drug Administration (FDA) yesterday radically toned down its "total ban" on alcohol advertising by permitting 24-hour indirect TV commercials that carry the name of alcohol companies without showing brand and logo of particular alcoholic drinks. The agency said some exceptions were essential to give the alcohol industry more room to manoeuvre. Apart from the initial exemption for foreign live telecasts and imported newspapers and magazines, the new rules include any form of advertising, both on TV and local print media, that does not carry the brand name or logo of alcoholic products. The name of an alcohol company is allowed to appear as a sponsor of a TV programme without time restriction, for example, as long as it is not the same name as the alcohol product, said Manit Arunaku, the acting secretary-general of the FDA. If an alcohol company makes other products, such as drinking water, and uses the same logo, advertising for the non-alcohol product is allowed only if the logo is in a different colour, he said. As for the controversial use of attractive girls for sales promotions at bars and restaurants, Manit said that will still be allowed as long as their dresses do not bear the brand or logo of the product they represent. The use of colour to represent a product in any form of media, including bar decorations, TV commercials or "sexy girl" uniforms is also allowed. As for alcohol displays at convenience stores, department stores and bars, the law will not be as strict as the ban on cigarette advertising, Manit said. Only displays of alcohol products blatantly promoted by advertising will be regarded as a violation of the alcohol ban. While broadening the exemptions to the restrictions on alcohol advertising, the FDA said it would not alter the punishment. From November 3 on, any violation of the ban will be prosecuted without warning, Manit said. The penalty includes a maximum three-month jail term and a maximum fine of Bt30,000.

Report from Bangkok Post dated Saturday 28 October 2006 :- Revised rules on alcohol ads blasted - Many questions remain unanswered ============================================ The government has eased some of its curbs on alcohol promotion, but advertising agencies and drink companies say the revised rules are impractical and would hurt companies with limited product lines. The comments came after the Food and Drug Administration (FDA) clarified the new rules in a meeting yesterday. Effective Dec 3, a liquor company's corporate image will still be allowed to be broadcast around the clock, but the brand symbol and trademark must be removed. Names of liquor companies will also be allowed on-air, but only on the condition that they are not similar to their alcohol brands or contain alcohol-related words, such as liquor, brewery and winery. Internet and direct-sales marketing will also be banned. Authorities will also consider hiking excise taxes for different spirits, including white spirits, as part of the campaign to cut alcohol consumption. The FDA also will impose measures to ban alcoholic beverage displays at discount stores or any points of sale easily seen by shoppers. Such measures were too stringent and impractical, representatives of the business community told the FDA, the Consumer Protection Board and Public Relations Department at yesterday's meeting. Zanita Kajiji, vice-president of marketing at Riche Monde, said spirits importers and distributors feared that the new regulations might affect the company's plan to import Johnnie Walker apparel - a fashion sport clothing line from Italy - because the FDA might prohibit the whisky brand's famous logo from appearing on other products. Ms Zanita asked the FDA why Singha and Chang bottled drinking water and soda would be allowed on TV and radio advertising as they would remind customers about beer made by the same companies under the same brand names. From the viewpoint of marketers, she said, the regulations were unfair. "Basically, they will ban any kind of ad that is deemed commercial in nature," she said. In addition, she said it was very likely that her company could not even advertise to promote its image because the FDA said clearly the new rules would prohibit operators that solely represent alcoholic beverages from advertising. Riche Monde only distributes and imports spirits under various brands including Johnnie Walker. Manit Aruntrakul, the acting secretary-general of the FDA, responding to the comment about Singha and Chang, emphasised that ads for those products must say very clearly that they have nothing to do with beer. On the radio, for example, advertisers must send strong messages to audiences that advertised only drinking water and soda. They must not mislead consumers, he said. Some alcoholic beverage firms shared the concern that the exceptions to the rules would be unfair to companies with only a single product line. Dr Saman Footrakul, head of the FDA's tobacco and alcohol control bureau, said the authorities would look at the concerns of alcoholic beverage advertisers. "If a drinking water business generates only a hundred million baht in sales revenue, but it spends billions of baht promoting drinking water or soda, that would not make sense," said Dr Saman. However, he said, legal advisers would consider revising that loophole and addressing any unfair business practices by allowing all alcoholic-beverage firms with more than one product line to advertise promoting their corporate images. He added that authorities would seek co-operation from the brewers of Singha and Chang to redesign their logos on non-alcoholic beverage products to avoid confusing consumers. They also plan to urge the Commerce Ministry, which oversees the Trademark Law, to not allow new trademark registrations that would mislead consumers.

What is the legal drinking age now? This will have pretty much zero effect on anything, and raising alcohol and tobacco tax from 2% to 4% is a ridiculous undertaking. We've discussed this before - slap a massive tax (30% or more) on hard liquor, and reduce the taxes on beer and wine. Of course, let me guess, more hard liquor produced in Thailand, than wine and beer?
