Swiss man jailed for 10 years for lese majeste

CHIANG MAI - A Swiss man was jailed for 10 years Thursday on charges of insulting His Majesty the King by vandalising His portraits during a drunken spree.

Oliver Jufer, 57, had pleaded guilty to five counts of lese majeste -- the crime of offending the dignity of a sovereign -- for defacing several portraits of His Majesty with spray paint in the northern city of Chiang Mai.

He had faced up to 75 years in prison, but the court sentenced him to 20 years and then halved the term because Jufer had confessed.

"The court has punished him for insulting the King. This is a serious crime, and he was sentenced to four years for each of five counts, for a total of 20 years," judge Pitsanu Tanbuakli said.

"Because he confessed, the court has reduced his sentence to 10 years," he said.

Jufer's court-appointed lawyer did not attend the sentencing, and Jufer said nothing as he entered or left the court. Prosecutors declined to comment on the case.

Two more videos mocking His Majesty the King appeared on the YouTube website yesterday, despite its being blocked in Thailand.

The military-installed government has been criticised by international media over the censorship.

The Ministry of Information and Communications Technology said it was in talks with site-owner Google over the case, but negotiations are thought unlikely to yield any result.

Tech-savvy Thai surfers have been able to access the videos through the use of proxy servers, computers outside the country that relay YouTube content back to the original viewer.

"The website will remain blocked until all the video clips are removed," said Sitthichai Pookaiyaudom, the minister of information and communications technology.

Those who posted the videos "want to create trouble. They have bad intentions towards Thailand," he said.

The ministry blocked access to the whole YouTube site on Wednesday after Google refused to remove a video deemed insulting to His Majesty.

Newspapers cannot provide a narrative of the video clips because of lese-majesty laws.

Last week a Swiss man was imprisoned for 10 years for vandalising portraits of the King.

The junta used lese-majesty as an excuse to stage the military coup that toppled Thaksin Shinawatra's government. State prosecutors are considering putting Thaksin on trial over the charge.

The decision to block YouTube has drawn sharp criticism from media-freedom groups, who said it highlighted a growing trend for the military government to censor political expression on the Internet.

"It's another example of how silly and ineffective censorship really is," said CJ Hinke, coordinator of the group Freedom Against Censorship Thailand.

His group, which lobbies for an end to online censorship, says the government has blocked 45,000 websites.

Global media watchdog Reporters Without Borders said yesterday it was concerned by the decision. It questioned the legal basis for censorship "initiated by the government and implemented with diligence by the police" without justice procedure.

"The closure or blockage of an online publication is a serious decision that should require a court order," it said in a statement.

In-your-face users of the YouTube video-sharing service have placed at least seven new video attacks on His Majesty the King on the website in the two days since YouTube disappeared the one that triggered a blackout in Thailand.

The attacks on His Majesty also got cruder and ruder early on Saturday, and all referred to a government attempt to block views of the illegal videos by users in Thailand.

Earlier, YouTube indicated it would help Thailand block access to certain pages that contain clips offensive to its revered monarch instead of blacking out the whole site.

But YouTube listed seven crude videos attacking the monarch in its search engine as of Saturday morning Thailand time, each with a sample photo and a description.

Each of the videos had dozens or hundreds of comments, almost all of them censuring or attacking the users who had uploaded them to the user-controlled video archive service.

The appearance of newer, cruder videos made it clear that Thai government publicity for YouTube, in the form of front-page statements and the ban on YouTube, had merely served as a red flag to the anarchic segment of Internet users that always flocks to such free-speech issues.

The YouTube problem poses a major dilemma for the government, which does not have the ability to impose a total block on YouTube - although seeing the site is difficult for many users in Thailand - and which only escalates the issue every time it discusses a ban.

Communications Minister Sitthichai Pookaiyaudom told the Reuters news agency on Friday that the idea came during a phone call with a California-based government liason officer of Google Inc, which owns YouTube.

The site had refused to pull out a clip insulting His Majesty the King. That refusal led the military-backed government to entirely block access to YouTube on Wednesday.

"He said pulling out those clips would not be an effective way to stop the damage, since users could re-post them again," Mr Sitthichai quoted his conversation with Google's Andrew McLaughlin, the firm's senior policy counsel.

"He said a more effective way would be to block certain pages not to be seen in Thailand," said Mr Sitthichai. "It will be a few days before we lift the ban on the entire site."

Gotta agree with that, and this is in fact possible with a cleverly designed traffic filter, which exists. The Thai authorities are now going to be in a pickle to set such a system up, which isn't (all things considered) too difficult to do. Any guesses what will happen?

King pardons Swiss lese majeste man

Chiang Mai - His Majesty the King has pardoned the Swiss man convicted last month of lese majeste for spray-painting portraits on the monarch.

"His Majesty in his kindness has granted him a pardon and he has been transferred from prison and is in the process of being deported from the country," said Chiang Mai Pol Col Prachuab Wongsuk.

Oliver Rudolf Jufer, 57, was convicted last month of lese majeste and sentenced to 10 years in prison.

A resident of Thailand, Jufer painted over the posters last year, supposedly while he was drunk.

Berne - The Swiss man granted a royal pardon by the His Majesty the King after being convicted of insulting the monarch, has arrived back in Switzerland.

Oliver Jufer, 57, was sentenced to 10 years in prison last month after spray-painting portraits of His Majesty while drunk in Chiang Mai.

His act was captured on close circuit television last Dec 5, the King's 79th birthday.

Jufer had admitted five charges of lese majeste when he appeared in court in Chiang Mai. Lese majeste laws in Thailand make it a serious crime to insult or belittle the monarchy.

In a statement, Swiss President Micheline Calmy-Rey welcomed Jufer's release and thanked His Majesty for granting a pardon.

Thailand to sue Google for insulting monarchy

Bangkok - Thailand's Information and Communications Technology Ministry said Tuesday it will go ahead with a criminal lawsuit against Google Inc for running video clips on its popular website YouTube.com deemed offensive to the monarchy.

ICT Minister Sitthichai Pookaiyaudom said he will proceed on Friday with the case against Google at Thailand's criminal court after the Internet giant rejected appeals to remove controversial video clips deemed insulting to King Bhumibol Adulyadej, Thailand's revered monarch who this year celebrates his 80th birthday.

Sitthichai added that the ministry is studying the case to determine if the lawsuit can be filed in an international court, reported the state-run Thai News Agency (TNA).

Thailand has strict lese majeste laws that make it a criminal offence to mock the royal family.

YouTube has reportedly asked the Thai government "by e-mail" to send the controversial clips deemed insulting the King as evidence so it will remove them as requested by Thailand.

Sitthichai said the request showed that YouTube was "playing a game".

Sitthichai has argued that Google had bowed to China's requests to block certain topics deemed politically sensitive, such as all references to democracy, so he saw no reason why it could not act similarly over Thailand's sensitivities over its revered monarch.

The ministry has blocked local access to YouTube since April 4, shortly after the first offensive clip appeared on the popular website which relies on contributions from the public at large.

Increasing government censorship of websites was cited as one of the reasons Thailand was downgraded earlier this month to 127th place out of 195 countries on the Freedom House ranking of press freedom.

Last year Thailand ranked 107th in the same listing.
