If not I suppose you would oppose any form of taxation, other than one that required each taxpayer to pay the same rate of tax, irrespective of the amount of his income because, to levy a rate which increased relative to the amount of income,would be to redistribute wealth from the better off to the less well off.

Nevertheless, this assertion is iterated verbatim in Article 48 of the Charter of Fundamental Rights of the European Union.

The Constitution of Russia, in article 49, states that "Everyone charged with a crime shall be considered not guilty until his or her guilt has been proven in conformity with the federal law and has been established by the valid sentense of a court of law". It also states that "The defendant shall not be obliged to prove his or her innocence" and "Any reasonable doubt shall be interpreted in favor of the defendant".

The Universal Declaration of Human Rights, article 11, states: Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which they have had all the guarantees necessary for their defence.

In the 1988 Brazilian constitution, article 5, section LVII states that "no one shall be considered guilty before the issuing of a final and unappealable penal sentence".

This is what I figured, and the true law-breakers are the ones who want to impose dictatorship and military rule on Thailand.

Shredded wheat,I would refer you to Mr Alan`s post which accurately sets out the position so far as the presumption of innocence is concerned in the criminal law systems of the overwhelming majority of European countries.

There are differences between the inquisitorial system that apples in most,if not all of Europe,other than the United Kingdom which has an adversarial system,principally in the role of the judge,the less frequent use of juries,and less strict rules of evidence which the absence of a jury allows,but the presumption of innocence has been the same at least from the time that a country became a party to the European Convention on Human Rights,although at least Germany and Norway had the presumption as part of their criminal law well before the Convention.

In any event how would you like to to be facing a criminal charge,and be certain to be convicted without the prosecuting authority having to produce any evidence of your guilt,unless you, in the face of all the resources a state has available to it,were able to establish your innocence.Because that is the result of having a presumption of guilt.

Thai ex-PM Thaksin charged with terrorism !

BANGKOK — A Thai court issued an arrest warrant Tuesday for ousted Prime Minister Thaksin Shinawatra on terrorism charges, accusing the fugitive former leader of fomenting two months of unrest in Bangkok that left 88 people dead.

If found guilty of the charges, he could face the death penalty.

Thaksin, who was ousted in a 2006 military coup and later fled abroad ahead of a corruption conviction, has been accused by the government of being a key force behind Red Shirt protesters who seized areas of downtown Bangkok before being overcome by army troops last week.
