The latest...

Dear Compexec1,

On your behalf, I have contacted the Immigrant Visa Unit of the Embassy in Bangkok, which handles fiancée visas. They have reminded me of the regulations which generally do not allow Embassies and Consulates to handle cases from outside of their districts. They also point out that they currently also have a substantial caseload of both Thai and Cambodian K-1 visa petitions (Bangkok’s district currently includes Cambodia for K-1 cases).

In any case, we have the following situation: We have reserved most of this week for support work for the ASEAN Regional Forum. We believe that we may have some free time for interviews but we cannot schedule specific officer time in advance. We have invited a number of K-1 applicants, including LG to come to the Embassy and wait for a possible interview. Please understand that LG may have to wait (perhaps even most of the day) until an interviewing officer is available. It is also possible that, depending on the demands on officer time, LG may not be interviewed. We have already contacted LG and it is our understanding that she understands and agrees to these terms. If she is not interviewed, she will receive an interview date probably in November.

Sincerely,

Gregory J. Adamson

Consul

Vientiane, Laos

What about transferring our case to a less backlogged embassy like Bangkok? The State Department web site shows only a 5 day wait there?

scobie
Has it ever occured to you, compy, that your constant bugging them might actually be pissing them off a little and that you're not really helping LG's case?

You're not in Philadelphia now, Dorothy. Things happen at their own pace here, and I know that if I was a consulate official being constantly questioned and having alternatives suggested by a yank on the other side of the world, I would be inclined to slip the relevant file a bit further down the pile.

You need these people's assistance more than they need you.

scobie (but then directed to compy)

I would believe its more of a case of what is said rather then how many times it's said. The key is not to piss people off that you are trying to get something from. As is human identity, what might piss one person off, might not to someone else. Sometimes it’s a fine line and as you say, you don't want to upset them where they now make it a point to hold up your application. (You sound like you have the perfect aptitude for a government employee scobie )

The other issue I would say is not to be seen as a queue jumper. To them, you are just another application with a number - something that doesn't warrant a transfer to another office. Unless you are a “somebody” don’t expect to be distinguished

I've seen red-tape in action (which was referred to in their latest correspondence), sure you can fight through it - but don't expect an apology as to why it took a 4 times (or whatever) the time a normal application takes. Usually building a non-adversarial relationship with who you have to deal with (even though you might hold a negative view about them) can help in ways that you wouldn't be aware of....

I think their last correspondence containing their offer was more then reasonable.

Cheers

Agreed on that one, and compy's response to their kind offer at expediting the situation, by essentially suggesting:

a) it's still not fast enough for him
b) they suck in their backwater, as opposed to a higher status office, like Bangkok.

Would really only work towards ruffling the feathers of consular officers that are already backlogged, overworked, and still trying to do the best they can.

I would not be surprised that, if LG isn't getting her interview on that date, the November date slips.

Furthermore, there is the issue of regional jurisdictions -- they have a Laos office, to deal with Lao citizens (which LG clearly is) -- suggesting to move the case to Thailand (of which LG is not a citizen), seems to demonstrate a misunderstanding of regional jurisdictions, and their purposes. My guess would be that the response by the consular staff (they are required to respond to all correspondence) will be to negate that transfer, and to most likely label this case as a result, as low-priority beyond the initial offer.

...or the squeaky wheel *could* get the grease.... but it's unlikely.

Compy,

I really feel that the Lao consulate are doing you a favour with these delays and you should put it to your advantge by using the time to really evaluate your feeling for LG to make sure that they are not simply Lust, loneliess or a lack fo something in your life stateside such as the excitement you get from a trip to LOS.

If you find no change in your feelings then great you will be a better and more content man for your patience. Afterall I have a feeling living with an Asian girl fulltime will take a lot of patience.

I agree! I emailed my thanks for the time and effort taken.

Update:

So I get a call from a crying LG a bit after midnight here, she said that she was missing form I-134 and that the next interview time would be in November. I looked up what the I-134 is on the internet, it is a “Affidavit of Support”, my lawyer had me send an I-864 an “Affidavit of Support Under Section 213A of the Act”… I’m meeting with my lawyer at 4pm today to understand what went wrong.

PS I will continue to push, but push in a very nice way!
