OK. Enjoy it while it lasts:
I, haam sup, was factually incorrect, at least as far as I can determine, regarding the legality of having sex with an 18 year old.
According to the Tourism Authority of Thailand:
POLICY ON PROSTITUTION
ADVICE FOR THE VISITOR
THE PROSTITUTION PREVENTION AND SUPPRESSION ACT B.E. 2539 (1996)
has been effective since December 21, 1996.
The following key points in the Act are to be noted.
The penalty for a prostitute has been much reduced.
A customer using the sexual service of a child prostitute under 18 years of age will be punished by imprisonment.
There are penalties for the manager, producer, supervisor, and owner of prostitution premises.
Anyone who procures or detains another person for prostitution will be severely punished, if the victim is a child not over 18 years of age the offender will be punished more severely, and if the child victim receives grievous bodily harm or the child is dead the offender will be punished with life imprisonment or with the death penalty.
A parent or guardian of a child not over 18 years of age will be punished with imprisonment and a fine and the custodianship may be revoked if the parent or guardian colludes with another person for sending his/her offspring or the child in his/her custody to be a prostitute.
If the perpetrator, aide or abettor in the offence of detention or confinement of another person for prostitution is an administrative official, police official, or official of a primary shelter or a protection and vocational development premises, such official will be severely punished.
The Act provides that there shall be one National Committee for Protection and Vocational Development and a Provincial Committee for Protection and Development for each province.
The Act stipulates that all prostitutes not over 18 year of age shall receive protection and vocational development for a period not over 2 years.
The private sector, a foundation, institution or association with the objective in prevention and rectification of prostitution problems can file an application with the authority to establish a primary shelter or a protection and vocational development premises.

PENALTY FOR THE OFFENDER
The Prostitution Prevention and Suppression Act B.E. 2539 (1996 A.D.) aims to prevent and solve the problem of child prostitution. Therefore, the act provides penalties for those who are the contributing factors which force children into prostitution as follows :
THE CUSTOMER
Penalties for the customer who buys sexual service from a child prostitute in a prostitution premises:
If the child's age is between 15-18 years old, the penalty is 1-3 years imprisonment and a fine of 20,000-60,000 baht
If the child's age is not over 15 years old, the penalty is 2-6 years imprisonment and a fine of 40,000-120,000 baht
THE PROCURER OR TRAFFICKER
Penalties for the procurer or trafficker who procures, seduces or trafficks another person for prostitution
If the victim is an adult, the penalty is 1-10 years imprisonment and a fine of 20,000-200,000 baht
If the victim is a child between 15-18 years of age, the penalty is 5-15 years imprisonment and a fine of 100,000-300,000 baht
If the victim is a child not over 15 years of age,the penalty is 10-20 years imprisonment and a fine of 200,000-400,000 baht
If uses deceitful means, threats, or violence, the penalty shall be increased by one-third,
THE MANAGER, CONTROLLER, PROCURERS OR OWNER
Penalties for the manager, controller, procurers, or owner of prostitution premises: 3-15 years imprisonment and a fine of 60,000-300,000 baht
If there is a child prostitute between 15-18 years of age on that premises, the penalty is 5-15 years imprisonment and a fine of 100,000-300,000 baht
If there is a child prostitute not over 15 years of age on that premises, the penalty is 10-20 years imprisonment and a fine of 200,000-400,000 baht
THE OFFENDER
Penalties for the offender who detains or confines another person for prostitution: 10-20 years imprisonment and a fine of 200,000-400,000 baht
If the victim receives grievous bodily harm, the penalty is life imprisonment
If the victim is dead, the penalty is capital punishment or life imprisonment
If the perpetrator, aide or abettor of this offence is an administrative official, police official, government official, or official of a primary shelter or a protection and vocational development premises, the penalty is 15-20 years imprisonment and a fine of 300,000-400,000 baht

Now PLEASE note:
This apology is posted here, under a new thread name, so EVERYONE will see it. It is, however, related to the 'Nana Plaza Raided' thread, wherein I jumped on Chompoo for his usual style, and was careless with my facts. To be quite honest, I would have bet the farm that I was right, having read and stored the notion that there was some reference to 20 year olds involved in prostitution vs. 18 year olds in a casual context.
Chompoo, as far as I can tell, was right about it.
I will refrain from indulging in further explanation, rationalization, or excuse.

Last month I got a brochure from the national youth bureau. SEX WITH CHILDREN IS A CRIME. It also refers to act B.E. 2539 of 1996 .
The punishment for the customer is somehow higher.
Under 15 years with or without consent : 4-20 years imprisonment and fine 8.000 - 40.000 baht.
15 - 15 year: 3 - 15 years imprisonment and 6.000 - 30.000 baht.
It says nothing about girls over the age of 18 years.

I am guessing that the article says "nothing about girls over the age of 18 years " Because the article is about "SEX WITH CHILDREN --------- " and girls over the age of 18 years are not considered children under these laws .

Thankfully i missed whatever thread lead to this...
But this is an Interesting report, my favorite part is about the penalty for administrative officials and police - they get some undefined "severe punishment" while every one else does jail time and pays a fine. yeah, they get a scolding for getting caught is probably about the size of it!
I know it's typical, but i think its amusing to see it officially documented.
