If they were serious about it, that is not how it would work.
You need a membership card to be a member, have to fill out an application, and most important, must pay your member dues (waived during the introductory period, of course -- and we have a special trial membership, for just a couple of hours, and you get two drinks with your membership fee).
Yeah, you're right, that would not work.

Last night Soi 7 BierGarden, saw no one smoking. The sitting areas near the entrance have "no smoking" stickers plastered on the tables. Also, it seems you can smoke in the enclosed 2nd floor area. Didn't go up to check if anyone there.
Thermae saw numerous people smoking and ash trays available. But, was told there were less people smoking than usual.
Previous night saw no one smoking at Tilac Bar, Cocktail Lounge or Apache (all Soi Cowboy).

Tonight at Shark Bar a punter came in with a smoke. One of the service girls immediately asked him to put it out and he complied.
Was in Spice Girls briefly. No sign of smoking - then again no sign of any punters either. Girls were on the scary side. Mamasan informed me they had a room upstairs to rent ST for 250bt. That, plus 400 barfine and 1,000bt to the girl would get me "anything I wanted". What I wanted was to leave...
Dundee had smokers and ash trays present. AFAIK, there were no "no smoking" signs posted. Couple of 7s in the bar.

I'm shocked,,
1) Man enters bar where gals are available ( illegal)
2) Man offered lady Illegal
3) Man offered private room with lady ( Illegal)
4) man offered to do " anything he wants", ILLEGAL
But all is ok as long as no cigarette was lit,,,, or perhaps we can go along the lines of an ex US President.. " but I didn't inhale". ?????

The policy is in place and the law will either be enforced or not enforced depending on the inclination of local officials and bar owners.
In any event all this whinging about your rights and freedoms is just that, whinging. I expect that the Thai government really does not give a damn what you believe your rights are.
Seriously, if you feel so strongly about it vote with your feet and stay away from LOS. If not, then 'put a sock in it' and quit complaining...

Illegal is a sick bird. The proper terminology in the English language for an act that is against the law is unlawful  , but then again very few people speak English these days...

My understanding is that unlawful means not authorised by law, but illegal means expressly forbidden by law. So we have unlawful combatants and illegal immigrants
