Hey all,

Recently had a conversation about owning land and property in Thailand. The conversation came to the point where someone said that if a Thai woman marries a foreigner, she forfeits her right to own land in Thailand.

Another guy said that that was the case in the past but that law had be changed and the Thai wife can own land.

Anyone knowledgeable on this topic?

she can own land, but.....

you must sign a waiver saying the you hold no rights to this land, even if it is your money that has paid for it

otherwise, they will NOT allow her to transfer ownership

if you're not legally married, and she hasn't changed her surname, best to just stay out of the picture and not let anyone know she has Pooa Falahng

I'm not sure how this helps Thailand. I might have hundreds of thousands of dollars to spend in my final years but they'll get very little of that cash because they apparently expect me to have nothing to show for it when I'm gone.

I have thoughts of buying land in Thailand at some point and figured it could be purchased in my daughters name. She will not only be an American Citizen but a Thai Citizen as well. Is this not a viable option?

1) You are talking about land, does this equally go for Property, i.e. house / condominium?

2) If I stay out of the way when my wife buys propery, will the authorities check

a) Wether she is married, as our marriage
only registered in my country, not LOS
b) Check where she as got the source of income
- the money comes from me
c) She has not abandoned her home address in
LOS

Form a Thai company with several Thai share holders and yourself ( perhaps some of her family members), company if it owns land must be 69 % thai owned so share ratio's must reflect this ( i.e you can have a max of 31% of the shares), shares and voting rights do NOT have to be equal,, so the 69% thai shares can have 69 votes and the 31% ( you ) ownership can have 31,000 votes. This would give you effective ownership/control.

Alternative 2, let it be purchased in your wifes name but have her "lease" it to you for 50 years with another 50 year automatic extension on the lease. Doubt any of us will be around in a hundred years to worry what happened. If you have children the lease can be passed to them in a will ( once again they are covered for 100 odd years).

These are for LAND purchases,,,, Condominiums CAN be purchased by Farangs within certain rules.

Several other alternatives exist but the above 2 IMHO represent the best options.

if they get suspicious that a foreigner is involved, they will not allow it

if your daughter lived in LOS full time until she was 18, shouldn't be a problem

oh, and she'd need to be 18 to be a landowner, I think

at least old enough to have an ID card, not sure what age they start doing that

but if you fly in the day she turns old enough and try to purchase land in her name, be prepared for denial

I know a lady who was going to transfer her assets to her daughter, half European

she had to show them the Father's DEATH certificate in order for them to process it

that's just how xenophobic these folks are

and thanks to mr. toxin things have gotten worse

if you go the route that Mel advises, option 1, then be prepared to shell out some money for a good attorney that can make it all look legitimate

you'll need office space, and 4 Thai employees, and YES they government WILL check up on you

I just had an interview at the courthouse last Friday, and they do mean business

Thailand does not allow dual citizenship while the US does. So if you get US citizenship for your son/daughter, keep it quiet and you should be ok to get it in LOS.

But I would worry that they can sooner or later check with the US Embassy before they grant the Thai citizenship.

In the US, if you are born on US soil, you are a citizen regarless of your parents legality. Don't know if being born on Thai soil confers automatic citizenship..... anyone know ??

Don't believe it does. Some of those "hilltribes" don't get the benefits of Thai citizenry, do they? Maybe someone can quote something a bit more solid, though, than my heresay.
