I was just chatting with a friend and he said that there is a new law (not yet ratified) that will give residency to a foreigner who married a Thai Citizen. After 5 years of residency the foreigner will then be eligible for Thai Citizenship.

My friend married a Thai women and took her to America. I think after only 3 years she is already a U.S citizen. However, I never heard of this law for Thailand. Just curious if anyone of has heard anything regarding this new law?

I don't know about the new rule, but I do know the OLD rule

before

you had to be in LOS 3 years back-to-back to even apply for residency

after you have residency and have been here back-to-back ten years, you can apply for citizenship

as for the NEW rules, I don't know

Don't think I'd want to be a citizen of a country that doesn't follow the rule of law. Interesting thread though, as I don't know anything about the Residency status issue, especially in regard to longterm retirement (haven't gone down that path as have no need to, so far), would be curious the hear more feedback from other bro's on this one, e.g., what perks, if any, are associated with it.

If my TGF (now fiancee) decides to stay in Amerika, it's doubtful she would apply for citizenship, as the Green Card status gives her pretty much all she wants here, and holding her Thai passport allows her to jet back home whenever she wants. Best of both worlds for her, at least for now.

Even if she becomes a U.S. citizen Balls she would not have to give up her Thai Passport. Not only does my wife want to be a U.S. citizen I personally think it will be beneficial for both of us. A Green Card allows her to return to the U.S. but does not give her any of the benefits of a U.S. passport. American's can travel to a bunch of places without little hassle which is not true for a Thai person. If we want to travel to anywhere other than Thailand I have to jump through a ton of hoops to get Visa's to whatever country we might visit. Not always an easy thing. IMHO the best of both worlds would be holding a U.S. passport (citizen) and retaining her Thai citizenship. Something she is allowed to do but unless the law is indeed changing in Thailand something I cannot do. I would not become a citizen and give up my rights as a U.S. citizen. My daughter will hold both a Thai passport and U.S. passport and will also have birth certificates in both countries. She will be able to own land in Thailand.

Are you sure about that for your wife? My understanding was that if a Thai citizen wanted to become a citizen of another country they had to give up their Thai passport and citizenship. The situation for children is as you state, my children have passports of my home country and their mother's (Thailand). We haven't pursued the option of my wife obtaining my home country passport, as she isn't interested (Thailand is perfect, don't you know!).

Thailand's Nationality Act translated to English...

Section 13. A woman of Thai nationality who marries an alien and may acquire the nationality of her husband according to the nationality law of her husband, shall, if she desires to renounce Thai nationality, make a declaration of her intention before the competent official according to the form and in the manner prescribed in the Ministerial Regulations.
Section 14. A person of Thai nationality, who was born of an alien father and has acquired the nationality of his father according to the law on nationality of his father, or a person who acquires Thai nationality under Section 12 paragraph 2 is required, if he desires to retain his other nationality, to make a declaration of his intention to renounce his Thai nationality within one year after his attaining the age of twenty years, according to such form and in the manner as prescribed in the Ministerial Regulations.



"shall, if she desires to renounce Thai nationality"... does not seem to be required.

On the other hand, Section 14 would seem to require that children holding 2 passports must choose one nationality or the other at age 21.

I am not an expert in US immigration law, but I thought it takes a minimum of 5 years to become a citizen (unless you were born in the US). You can get a green card much sooner if your spouse is a US citizen.

BTW, in the US one is automatically a citzen if born here, even if ones parents were illegal immigrants at the time of your birth. Are there any other countries with that policy?

Not that I am aware of. I think USA is the only country that has that provision. If you are born in the USA you are automatically a citizen.

Mr. Alan is spot on here. My sister-in-law had to wait five years once she first arrived in the US to get citizenship (but that was 20 years ago).

According to my mates at my local in Marlow (Bucks). The UK also has that provision and I believe that it is part of the current EU charter...
