Thinking about divorce...Hmmm.

If I had have shot my first wife 30 years ago, when we split up (she took half the house), the property would still be mine and it would be worth a small fortune now (In Thailand anyway).

I would be free and also a rich man (in Thailand anyway)... Funny old world init...

As I understand it, there is no guarantee she can get a visa to the US even though you are legally married. Visas are issued at the sole discretion of the State Department member you are being interviewed by. Obviously if they are having a bad day, you will probably not meet with much success since the decision making is so arbitrary. I never tried to get one so I am speaking from second hand experience.

A child born to a married couple is eligible for citizenship if one parent was a US citizen at the time of birth. However, if the child does not have obvious farang features, the Embassy will make you jump through hoops to get the citizenship...dna tests, proof you have been supporting the child, photos of the family and all sorts of silly sh_t. However, if you were married at the time of conception and still married at the time of birth, State will have a very difficult time not approving the citizenship. If they disapprove it, they are effectively calling your child a bastard and this does not look good on CNN.

I will explain it all over a cold one next trip but do not let State push you around on this. They have no legal right to disallow citizenship if you were married at conception and married at birth and have cared for the child since birth.

I would say you would not be able to get a Thai divorce if you were not married in Thailand. One of the requirements is to surrender the original marriage certificates. My ex-wife did not bring hers to the gala affair and had to go make a police report that it was lost before we could proceed with the divorce.

I know the Embassy and Consulates in Saudi recognize the marriage/divorce but do require translations into English. I had to present a translated copy of my divorce decree, proving I had legal custody of my daughter, before the US Consulate would add new pages to her US passport.

I never did officially register my marriage with an Embassy or Consulate.

VJ, are you saying that if your married in Thailand the US embassy/US Immigration will recognize that as a marrige and there will be no need to get a marrige in the US

so you could get married over there and not have as many of the legal worries as you would if you married in the US like an insurance policy if she goes crazy some day I could just bring the girl back give her some cash and come home single again ?

I cannot speak for today, but when I was in this situation as far as the child it was very easy. Birth Certificate showed me as the father, nationality was listed as "Not Thai". I simply had the birth certificate translated, took it to the embassy and they issued a "Certificate of Birth Abroad" and a US Passport. Was never questioned about anything, however I was already married in Thailand.

zim, I know all those words, but the way you've strung them together makes my head hurt.

The key here is reciprocity -- if you're married in one country, you don't become unmarried by moving to another.

I've got two western divorces under my belt and neither has been a pleasant experience - get the paperwork done properly is my only advice - no matter what country you are in there is a substantial penalty for bigamy - two wifes!!!

My friend, born and raised in the USA, married a girl in China. Both in their early thirties and the girl is an office girl. It's been over a year now and he still cannot get a visa for her to come to the US.
