that would have to be the most naive gullible statement I have ever read on this forum, or any others for that matter....just have to do it again

Hi all,

Has anyone heard of what is called a "USUFRUCT"

I sold condo's in Thailand for awhile and had never heard of the procedure. Probably becuase I never did any land deals. I just dont know if it is a legit option.

From what I understand the Thai wife has the land/house in her name but you would also get a "book" as a registered user (this can be for as long as you live).

The house can not be transferred without the registered users signature, even if she dies or you guys split up.

I dont know the specifics, having read about this occuring in Chang Mai (where I hope to buy/build a house when the wife and I retire back to Thailand)

any insight would be much obliged.

Can a foreigner on a tourist visa, and with the money, buy a car or a piece of real estate in Thailand? If they can, what other documents might they need?

There are two issues in this query: can a tourist buy a car and can a tourist buy real estate.

A tourist, having only a tourist visa, cannot buy a car. To buy a car, a non-Thai must hold a non-immigrant visa, which must be presented to the car registration office together with either a letter issued by the relevant embassy confirming their address in Thailand or an employment confirmation letter issued by their employer in Thailand.

A non-Thai holding a residence permit must present a house registration certificate.

If the purchase of the vehicle is to be financed, for example under a hire purchase contract, the financial institution will usually require a guarantor who may be a Thai citizen, a Thai company or a non-Thai holding a residence permit. Some financial institutions do not require a guarantor if the down-payment is higher than 30 per cent of the purchase price and the purchaser has a good financial status.

Non-Thai citizens are not permitted to own land except in limited circumstances when permission has been granted by the Interior Ministry. To be eligible for such special permission, the non-Thai must bring no less than Bt40 million into Thailand and invest this amount in qualifying investments (government bonds, property mutual funds, etc) for at least five years.

However, a non-Thai may purchase a condominium unit provided that overall non-Thai ownership of the particular building remains less than 50 per cent and that the funds used to buy the unit are brought into Thailand in foreign currency.

Obtaining a mortgage for a condo is usually only possible for holders of residence permits or persons allowed to enter the Kingdom under the laws of investment promotion.

Can anyone recommend a real estate lawyer in BKK.

I am looking to buy a condo and want someone to look over the papers and make sure I am really buying the condo from the true owner, that I am really getting a deed, that there aren't any surprises and that sort of stuff.

I've seen estimates for condo maintenance fees, and utility costs mentioned. And discussions of title insurance, etc.

But what about property insurance? I would assume one must insure their condo/house against fire, etc.

"Usufruct" is simply the right given or sold by an owner, to someone else, to use and derive benefits from a property, under whatever terms are mutually agreeable, and are within the laws of the country.

As it is often used in the US, usufruct is a legal/tax device which allows parents to grant ownership/title of a house to children (or grandchildren) before one's death, yet retain quiet/non-destructive use (usufruct) of the property by those parents until their death.

There are cases of parents who in good spirit transferred title (without usufruct) to their children before death, with only a verbal understanding to remain there, only to be kicked out by the kids sometime later. Sad but true.

Thai laws regarding usufruct will no doubt be different in its details, but probably the same in general. I can't imagine however any law anywhere which does not allow transferability of a property after the death of the registered owner.
