Has there been any bursting of the price bubble for condos in Bangkok or Chiang Mai. Here in California there are a lot more homes on the market and prices are down from their highs. I wonder if the same is true in Thailand.

I am interested in a condo probably in Chiang Mai but maybe in Bangkok. Last November when I looked the prices were ridiculous. Condos were almost sold out before construction even started. Units on the market after the building completion were marked up 20 or 30%.

Have prices come down any lately?

New property law stuns foreigners

Bangkok - Thailand's booming property sector has been thrown into confusion by a new regulation issued this month that requires all partly foreign-owned companies to prove the source of their funding before purchasing land, industry sources said Tuesday.

The new Interior Ministry regulation that went into effect on May 25 has already started to slow sales of housing estates in Thailand's popular seaside resorts, such as Pattaya, Phuket, Hua Hin and Samui Island, which have been specifically targeting well-to-do foreigners as vacation getaways or retirement homes.

"The property boom ended on May 25," said Ronachai Krisadaolarn, managing director of Bangkok International Associates, a Bangkok-based legal consultancy firm that caters to foreign clients.

Thailand has strict laws prohibiting foreigners from directly purchasing property themselves although loopholes in the law allow them to own land and their houses through long leases or a "nominee company," providing the company is majority Thai-owned.

It is common practice for such "shell companies" to include Thai nationals who have been paid to act as nominees to facilitate the deal and who have invested nothing in the purchase.

The new regulation, signed by Suraart Thoingniramol, deputy permanent secretary of the Interior Ministry, is designed to halt the use of such companies for property purchases in the future.

"If it appears that an alien holds shares or is a director or it is reasonable to believe that a Thai holds shares as a representative of an alien, the officers shall investigate the income of Thais holding shares, delving into the number of years [they have spent] in the current profession and monthly salary," reads a translation of the law. "The provision of necessary evidence is required."

The new regulation is actually an enforcement of Thailand's existing laws, legal experts said.

"It's not a radical change. It's a radical implementation," Ronachai said.

The regulation has already started to stall home sales to foreigners, sources said.

"There's a lot of confusion," said Simon Landy, managing director of the Primo Co, a property-development firm. "Some land offices don't know what to do with it, and many have simply stopped transferring land."

this is a big problem ONLY if they do a crack down. If some nut head came to power and start telling the police to check every company. Its always the same you are ok untill they check you. If you want to be on the safe side buy a condo then there is no problem.

LOL….No no and NO….that’s no incentive to the Thai wife since she’ll get the matrimonial property once you die anyway …
It’s her relatives, like the creepy ex-police uncle or the Thai brother-in-law by marriage with the dead-end job or even a desperate old friend or two that will have an incentive cause once SHE is rich they’ll have much easier access to all that money….Enjoy

What is the big deal with the BKK Post report? The report says the Govt is going to be investigating the tax affairs of the Thais not the farangs?

What do the tax inspectors expect to gain from making enquiries of some Issan farmer labourers that have no real income to speak of? How has that killed the property market?

I understand that reading is a lost art, as is apparently reading comprehension.

and

"If it appears that an alien holds shares or is a director or it is reasonable to believe that a Thai holds shares as a representative of an alien, the officers shall investigate the income of Thais holding shares, delving into the number of years [they have spent] in the current profession and monthly salary,"

Make it pretty clear. Still, this only appears to be an issue for those situations where there is clear abuse of this process.

There was a post on another forum yesterday advising that a farang had gone to the land office in Pattaya to buy a house in his corporate name.

The land office turned him down, stating he had to bring all the board members in to be questioned and he had to divest himself of his stock in the company.

He went on to post that a number of farangs were similarly turned down.

Seems like yet another attempt to penalize the farangs for bringing money in to LOS. It will hurt the market.
