Shredded Wheat
I vaguely recall reading somewhere (maybe on the internet) that it is possible for a farang to own land in Thailand if it is inherited on the death of a Thai spouse from the Thai spouse. That a limit of 1 rai applies.

Can anyone here confirm if this is the case please?

Shreddie:

My information is farangs cannot own land...period. If a spouse dies intestate, the land is parceled out in accordance with Thai inheritance laws.

A farang can own the house but not the land. Thai Visa has some threads about this.

My home in Pattaya is in my daughter's name.

My home up-country is in my wife's name.

All I own is a car, a couple of motorcycles and three sets of golf clubs.

Sounds like you hide your baht in your Golf bags. That explains why you have so many bags. I can't imagine a Thai person looking there so good idea EPC. And having heard some of your golf scores there can be no other reason for 3 bags. Sounds like EPC is pretty much an expert on not owning things in Thailand.

Well,, now lets get the facts straight,, if a farang recieves land from a deceased estate he can actually own it,,, but he has only 12 months to sell it as he is not allowed to own it,,,,LOL. Strange but true.

I'd sell it to a Thai company that you are managing director of,, thus negating the problem.

Now see the problem of BTF... one says 'no', one says 'yes'... now let's wait for one who says 'maybe'.

You better seek legal advice from a real lawyer..

That has been an allowed work-around (wink-wink), but the Thai legislature has proposed changing the law and/or enforcement to end that loophole when it is set up as a sham corporation. Worse - they are considering going after pre-existing property incorporation shams.

I wouldn't touch Thai property with a ten-foot pole, except legal condos, unless I were prepred to walk away from it with absolutely no regrets. Placing it in a child's name is a mite better than in a wife's name, the only other reaonable alternatives. But what percentages of marriages end in a divorce ('Oh- but mine is different...'), ESPECIALLY when the little lady is holding ALL the marbles?

And otherwise good children have been known to screw their parents over for property, particularly at the behest of their down-and-out, druggie, gambling, or just plain larcenous spouse, a major outside influence beyond your control (or of course at the behest of their angry mother?).

Cynical? Yes!

Reality check? Sure!

BTW I heard a GREAT story about a farang who built a beautiful house for his lovely Thai wife, only to have her run off with a Thai lover shortly thereafter, with the property (land) of course in her name. He is reputed to have rented a bulldozer and trashed the house to unsalvageble bits - and the authorities supposedly could do nothing about it as he legally owned all improvements to the land.
