Next month I will marry my TGF and bring her to the USA. Her extended family lives in Ubon Ratchatani. A piece of property may come on the market that is adjacent to the family land. My fiancee would like us to buy the land should it come onto the market, as then she would have property (I know it would be in her name) right next to the rest of the family. This is unimproved land. I'm not asking advice on whether it is a sound decision to purchase land in Thailand, or whether it is a good idea to have land in my fiancee's name. What I am looking for from the members are any additional questions that I should be asking (or modifications to those questions below) AND how to go about finding out the answers to those questions. 1) Does the person who says they own the property actually own the property? Do they have legal title and can they legally sell the land to me? Is there clear title to the land in the current owners name? 2) Are there any leans or other emcumbrances on the land? (i.e., does someone else have a legal claim to the land) 3) What is a fair appraisal of the value of the land? 4) Where exactly is the land? Is there a survey or other document that exactly describes the location of the property? 5) Does the land have access to the public road? 6) Can I legally build on the property? Is there any limitations as to what I can do with the property? Are there any zoning or deed restrictions to the use of the land? 7) Is there water, sewer and electrical already on the property? 8) Is there anything wrong with the property that I need to know about? Like a hidden well of water, unstable land, high water table, poor site drainage, or anything else? 9) Are there any annual (or regular) maintenance fees or taxes? If so, what are they? An example might be taxes. 10) In addition to the selling price of the land, what other closing costs are there? In the USA the combination of a Real Estate Agent, Lawyer, Mortgage Company and Title Insurance Company (as well as the buyer) ensure accurate answers to these questions. What exists in Thailand for this purpose? I understand that there is a Government Land Office in Thailand that I should deal with.

best way it to hire a real estate agent. That way all your answers get solved Or just find a real estate agent and ask them to show you around to a few places. Eventhough you dont intend to buy, thats not a problem. At least you get alot of information

Speaking from experience - whatever your tilac tells you it will cost in the future to build your (her) house - double it, add a million arguments, add a million grey hairs from dealing with the building contractors - and you are half way there. My Thai wife had land bought for her next to the family land, by her ex husband. At the time I thought great - I own land in Thailand and in the future we can build a big house etc. I did not anticipate paying her family to look after the land, paying her family to put a fence round the land, paying her family to keep chickens on the land, paying her family to grow trees on the land, paying her family to cultivate the land... paying her family to piss on the land... I think you get the picture. With regard to your questions.... you have to be able to cope with the "Thai Way" of doing things. It is extremely frustrating and completely different from what you are used to. I had similar questions... Good luck.

I remember there use to be a rule that a Thai citizen who is married to a foreigner cannot own land in her/ his name. If that still exists and to which extent, don't know. The titles are probably registered at the Land Department so they could be probably checked at the Amphur. My guess is to ask advice at a lawyer like Sunbelt. They are familiar with these issues. 555, good luck in dealing with the land office, they probably will tell you to either buy the land or get f***ed, LOL 1. if you can buy the land & go thru the land office, then it's in the current said owner's name, or else they would not sell it this is almost the only good information you can learn from them, but just by visiting & trying to make a transaction 2. similar to #1, they will tell you about any legal situations that exist prior to purchase, even if the said owner did not, but be sure to ask 3. they most likely will not divulge that unless you are buying it in the name of a company, which you can legally do if you start a company in LOS 4. yes, there will be point markers on the corners, and if not they will make an appointment to put them there 5. that is all due to future progress, not their concern either, sorry 6. that is all due to where the land is & how big is the property, but I think you can do pretty much whatever you want as long as you get the proper permit prior 7. didn't you say yourself it was undeveloped ? 8. neither the owner or the land office will tell you this, just ask the neighbors, your in-laws 9. there shouldn't be any maintenance fees outside of taxes, unless it's in the middle of some Estate that you are buying into 10. they will definitely tell you about the closing cost when you buy it, because they will collect them the same day romeland, get a divorce rit, don't get married

A friend of a friend did this and went through Sunbelt. He was very happy with doing this. Although he did not own the land, he has a Long term lease with rights to renewal. Some questions are answered here: http://www.thaivisa.com/own_land_thailand.0.html One point of view is to hire someone not connected to the land or your GF families property to represent your interests. That is what I would do. But then again, it is not YOU buying or owning the property, it is your GF (and in reality, it will be her family). When all is said and done, you don't own it (unless you get a Thai company formed by Sunbelt). And it is good that you are not asking advice on whether it is a sound decision to purchase land in Thailand, or whether it is a good idea to have land in your fiancee's name. I expect you know the answers to these questions. A little bit of money for land in Thailand will be a drop in the bucket if you do not apply asset protection to your U.S. based assets, but I imagine you know this or you would not be taking the "financially life changing step" of marrying a foreigner and letting her become a resident of Amereka.

ahhhhhhhhh removing tongue from cheek divorce in the US is MUCH more expensive than in LOS. When I married my wife, 5 members of her family drove 450 miles to her mother's home with a land deal for me. What a coincidence that this land was right next to the family property too. My wife, bless her, never allowed the offer to grace my ears. She knew what my reaction would be after my laughter had subsided. But don't worry. If you marry her, you will have many opportunities to "help". It is just the nature of the situation. Poverty + farang = Ongoing Orientation.
