Being a free country does not mean that one can whatever one wants. Child pornography is definitely illegal and US porn filmmakers must follow strict procedures and provide documentation to ensure that all actors are 18 or over. There are some European filmmakers who do not import their DVD's simply because they don't have the documentation necessary.
If the DVD is a copy of a US video, then it is legal from a pornography standpoint, but the counterfeit DVD is another story.
