Have mailed DVD copies and also GUCCI, LOUIS VITTON copy bags from time to time via Thai P.O. in the past with no problems. Recently, packages have always been opened by US customs with some items confiscated. This is a new tactic, the boxes are small with only one or two purses inside and sent very infrequent.

Any thoughts on how to better send such items. Fedex is no better these days. Any experience from you guys?

Second the motion on FedEx.

A couple of years back my wife and I were spending several months in the US so we sent a couple of large boxes of clothing to the US via FedEx in addition to the luggage we took with us. Both boxes were both siezed in Alaska where FedEx clears customs and it tooks us weeks of telephone calls, first to FedEx and then eventuallty to customs, even to find out for sure where they were.

Customs insisted that some of my wife's clothing, including two handbags, was counterfeit. It was not. At least, it shouldn't have been and as far as we knew it wasn't. It all came from major, legitmate vendors here in Bangkok, but naturally you don't get certificates of origin when you buy clothing.

Customs demanded original receipts for everything. Now no one saves receipts for ordinary clothing they purchase on a daily basis, unless perhaps you're a tourist on vacation to do some shopping, and of course customs knew they were asking something that almost no one can do. We have lived in Thailand for 15 years. We don't have receipts for our day-to-day purchases.

Didn't matter. Tough cheese, customs said, and seized everything, both the few items they claimed were counterfeit and and all the rest of our stuff as well in spite of cheerfully admitting that it was entirely legitimate. What did FedEx do? Within 24 hours they had washed their hands of the whole matter and refused to get involved in any way. I demanded a refund from them for the (considerable) shipping costs and they never even replied.

Bottom line: several hundred dollars in shipping costs wasted, another hundred or two in telephone bills, and all the clothing we shipped stolen by some customs folks in Alaska who apparently liked it a lot. Moral of the story: anytime you ship anything to the US, you just hope for the best, regardless of whether your intentions were good or ill.

When returning to the US, you may legally bring back only one counterfeit item of each kind per person (one watch, one handbag, etc.). However, the counterfeit items must be for personal use only and must accompany your person as you clear US customs (the items cannot be shipped back as the above posters have experienced for themselves). The presumption is that if items are shipped back, they are not for personal use and are for commercial resale (the government cannot track how many shipments you make). In addition, you must not sell any counterfeit items legally brought back with you for a period of one year of entry into the US.

The above does not apply to DVD's and software, which are not technically trademark infringements. Instead they are illegal copies of the original copyrighted material and are always illegal no matter how you bring them back or how many you bring back. But from a practical standpoint, US Customs is usually looking for people bringing back illegally copied software for potential resale, which means commercial quantities.

The international trade of software, DVDs will definitely decrease. Not because of less demand or changing behaviour, but the coming of Rapidshare and other file hosts which allow easy online sharing of these pirated goods.

Don't know what you're getting at?

But these rules are simply there to keep their hands clean. Of course Rapidshare knows that 99% of the stuff is against their rules. But that makes them so popular and takes care of their income.

It is true that they remove stuff not because they find it, but copyright owners complain. 5 minutes later another copy is posted...

They even give points and free premium accounts for people who uploaded their illegal stuff...

When a pirated film exhibits the registered trademark of the producer and/or distributor on either the packaging or content, it then also is a trademark infringement.

Copying of copyrighted material is not done by the individual who has purchased it and bringing it back to the US. The purchaser becomes an accessory to the pirate and consequently can have the counterfeit goods seized.

Jumpin Jack, IMO, don't send them at all. Pirate goods are controlled by the same lovely people who control the illegal drug, guns, human trafficing, etc. The margins are much better on DVDs than drugs and the penalties are less severe. As a result, better for busisnes. But for a few dollars more, get the legit copy.

What is telling here is that in the US we can bring in a pirated watch, bag, track shoe, dinner jacket, tie clasp, etc. for our personal uses but no DVDs or Music.

Well let's look more closely:

The best watches, bags, track shoes, dinner jackets, tie clasps, etc are all from EU companies.

The best DVDs and Music are from American companies.

Interesting yes???
