Nomadic, Yes, I'm sure it's been done. Anything is possible. However, most don't seem to have the same luck as your girl. Was it a tourist visa? If you have some insight on how she accomplished it so easily, please share with the brothers here. Many have TGs they would like to have visit them in America.

My TGF got a ten year visa on her first attempt. She was thorough in her preparation and speaks english fluently. Only thing I did was to send her an invitation letter as a friend. Well educated professional for 3+ years and under 30. I was pleasantly surprised. So now I know it can be done. May be with some luck and solid preparation. Guess it all depends on the interviewing officer and how they perceive the candidate.

My TG who has lived in the UK for over ten years could not get a US vacation visa last year. She has worked in the UK and of course does not own property in the UK--like half the population. She was coming to see me in Las Vegas--the only thing I did not do was provide a "sponcership" letter. Does this help to influence the embasey--Esp if you are a community leader. I am waiting for my divorce to be final and will end up doing the fiance Visa but would like her to visit before she commits.

This will be a long post but perhaps it will provide some insight into the application process for a Visa to visit the United States. Please read the post from me on 1/2/04 which is quoted below. I am adding to this post the letter I received from my U.S. Congressman, John Linder, who sent a letter to the U.S. embassy in Thailand on behalf of my friend. Below is the letter the embassy sent in reply to their inquiry. Her second denia was after the letter was send from John Linder's office.

After the first attempt and rejection she reapplied with a letter from my congressman from the state of Georgia trying to help with the process. The offices said they can not put any pressure on the embassy staff to approve her visit but a letter on her behalf could help. No such luck. She has been turned down on two seperate instances. It is also my understanding that repeated applications further hurt the chances of getting a tourist visa into America. Overall I'm pissed because she is not a young sex kitten. 38 years-old with perfect credentials for a visa to visit the US. Don't understand why Thailand extends to me the courtesy to just show up at the airport and like magic I get a 30-day stay with no hassle but my country refuses to extend to her or Thai nationals the same courtesy. I guess I will have to consider a fiancee visa as my next alternative. LS
Letter from US embassy to John Linder's office: Ms. XXXXXXXX Thank you for your correspondence. Ms. xxxxxx again applied for a tourist visa on May 9, 2003 and was interviewed by a consular officer. Her application was again denied under section 214 (b) of the Immigration and Naturalization Act (INA), which requires most applications for noimigrant visas to show a permanent residence abroad and an intent to depart the U.S. at the end of the authorized stay. This may be done by providing evidence of compelling social, family or economic ties outside of the United States. Section 291 of the INA places the burden of proving nonimmigrant intent on the applicant. The consular officer must objectively evaluate the facts and circumstances of each case to make a judgment whether the applicant has met the burden of proof. Unfortunately, Ms. XXXXX was not able to demonstrate sufficient evidence of ties outside of the United States to convince the interviewing officer that she intened to depart. An American, nor anone else for that matter, cannot take responsibility for an applicant. Each applicant is assessed on his or her own merits. There is no document that can be signed or bond that can be put up in order to ensure the return of an applicant to Thailand. Your constituent should also understand that, while we are in no way questioning the credibility of his promise to support Ms. XXXXX while in the U.S., that promise cannot substitute for strong ties to Thailand. A denial under Section 214 (b) is not a permanent ineligibility for a visa. If Ms. XXXXX believes that she can show strong ties to Thailand, she is welcomed to apply again. Her application will be given every consideration with U.S. laws and regulations. However, she should understand that, unless evidence of significantly stronger ties outside the U.S. is provided, the application will again be denied. I hope this information is of assistance to you and your constituent. Sincerely, Vice Consul U.S. Embassy Bangkok, Thailand *This my friends is bullshit. I mentioned in my earlier post her credentials and I'm not sure how you could possibly demonstrate stronger ties to your country than the documentation she presented with her application. This second application was submitted in 2003 and we have not reapplied since the second denial. LS

LS Feel terribly sorry about your ordeal with US Immigration. I am wondering whether our sponsorship letters showing close ties or GF type of relationships actually hurt their chances of getting a tourist visa. In my case I sent her an invitation letter as a friend and nothing more. And I was not involved in anyway with the application/interview process. Secondly would there be discrimination among thais ? Where is your GF originally from. My GF was born and raised in Bangkok. I also know that couple of her friends got 10 year visas. The problem seems like there are no rules or specific yardsticks in application of the law. It is basically left to the judgement of the consullar officer and I believe they don't even have to justify a denial. In the current atmosphere I see no hope of the situation changing for better.

LS, your story saddens me. When my TGF applied we also thought every base was covered and when she was rejected it was one of the single saddest days of our lives. She does not want to apply again b/c of how much hurt she experienced. Now it is down to the fiance visa.

Yes, she was very sad indeed. She had a few places she wanted to visit in the U.S. and her bosses daughter is in school as well in Florida. I had a lot of things planned. It's just not fair to her but I tried everything I could think of but to no avail. LS
