I looked for a thread and can not find one on bringing stuff back from Thailand. Can you bring DVD's CD's ect? Is it OK to do so? I read a couple of threads saying that they had to conceal there software purchases, so I assume it is not ok! Could someone direct me to a thread or shine some light on the subject? I would like to send items if possible or bring some back with me. As always Thank you for all the help you are making my fist trip a great one!!

Mr Alan
If you are coming back to the USA, you can generally bring in one counterfeit item of each type. For example, one counterfeit handbag, one counterfeit watch (not one of each brand). You must accompany the item through customs (cannot ship counterfeit items back to USA). I believe that the 1 item exemption applies to software and video, but am not 100% sure (see below)

Note that the duty free exemption has been recently raised to $800 per person for returning US residents.

For non-USA residents coming into the USA, the exemption is $100 (this only pertains to items that are not taken with you when departing the USA).

Trademarked and Copyrighted Articles

U.S. Customs enforces laws relating to the protection of trademarks and copyrights. Articles that infringe a federally registered trademark or copyright, i.e., that use the protected right without the authorization of the trademark or copyright owner, are subject to detention and seizure.

Articles bearing marks that are counterfeit of a federally registered trademark are subject to seizure and forfeiture. Additionally, the importation of articles bearing counterfeit marks may subject an individual to a civil monetary penalty if the registered trademark has also been recorded with Customs. Articles bearing marks that are confusingly similar to a registered trademark, and gray market articles (goods bearing genuine marks not intended for importation into the United States) may be subject to detention and seizure.

However, passengers arriving into the United States are permitted to import one article, which must accompany the person, bearing a counterfeit, confusingly similar or restricted gray market trademark, provided that the article is for personal use and is not for sale. This exception may be granted not more than once every thirty days. The arriving passenger may retain one article of each type accompanying the person. For example, an arriving person who has three purses, whether each bears a different infringing trademark, or whether all three bear the same infringing trademark, is permitted one purse. If the article imported under the personal exemption provision is sold within one year after the date of importation, the article or its value is subject to forfeiture.

In regard to copyright infringement, articles that are determined to be clearly piratical of a federally register copyright, i.e., unauthorized articles that are substantially similar to a material protected part of a copyright, are subject to seizure. Articles that are determined to be possibly piratical may be subject to detention and possible seizure. A personal use exemption similar to that described above also applies in respect of copyrighted articles.

You may bring back genuine trademarked and copyrighted articles (subject to duties). The copyrighted products most commonly imported include CD-ROMs, tape cassettes, toys, stuffed animals, clothing with cartoon characters, videotapes, videocassettes, music CDs, and books.

Mr Alan,
Great reference, thanks.
Software, music, and film industries are getting serious about prosecutions, so you 'takes your chances' to the tune of thousands/hundreds of thousands of $$$ of very possible fines. There are other electronic ways however, other than trying to schlep a bunch of pirated CDs through Customs...

Don't make the mistake of taking Customs guys for dopes. I read about a dude who got caught by a knowledgeable Customs guy, trying to pass off an expensive Iranian handmade carpet as a cheap manufactured one, even though he had sewn on a false tag.

Hey ramster5555
I bought about 10 CD's containing loads of softwares pirated ofcourse from the famous PANTIP PLAZA. without any fear I put all the cd's with the packing and stuff in my unaccompanied bagage. I was not stoped either at the thai customs and neither at the customs check in at the New Delhi (India) airport.

I do not know whether the US Customs would do the same but I did not have any problems bringing them into my country.
Best of luck to you for the same....

That you weren't stopped on that one trip was good for you - and though I don't know specifics about other country policies, Customs everywhere does random searches, and a hundred guys ahead or behind you might get a sh*tload of stuff through, but if you get the lucky draw in the US you're f*cked!
As I said earlier, 'you takes your chances'...
'Up to you'.

stuckinapub
done it loads of times
with software I generally copy the cd onto my laptop and throw away the discs
I dont buy dvds I buy cvds you can copy them onto a hard drive by copying the large dat files in the MPEGAV directory rename them with the MPG extension and windows media will play then no problem

two trips back I was pulled at heathrow bags searched from top to bottom some sharp questions about bringing porn in but the obvious intrest was drugs

ended up getting about 20 movies and about 50k worth of software past customs

if you are realy paronoid you can use PGP to encrpyt all that dodgy software and movies and hide the files I would sudgjest inside the windows directory

What I do is make some copies of music CD's that I listen to on the plane trip on my portable CD player that I bring with me. It is perfectly legal to make CD copies for personal use if one owns the original CD (which I do). Then if I buy any software, I remove the CD's from the original packaging and intersperse them in with my music CD's.

Before discarding the packaging, I write down any needed serial numbers/keys and email them to myself back home. Make sure you get rid of all the original packaging (including the telltale cellophane sleeves used in BKK).
