Bt10m worth products seized in MBK, Indra Square raid

The Department of Special Investigation (DSI) seized 23,000 pieces of counterfeit iPhones, iPads, cellphones and brand-name clothes worth Bt10 million from five shops in Bangkok's Indra Square and MBK Centre, senior officials said yesterday.

DSI chief Tharit Pengdit and Pol Colonel Pravesana Mulpramook, director of the DSI Intellectual Property Crime Bureau, said yesterday that initial investigation showed the five shops, all called Zirtel, were owned by a private firm. DSI was checking to see if a politician or influential figure might be involved. The company's board members will face charges and most of them have already contacted DSI to surrender.

As for owners of the retail space, the DSI has warned them that if violators of the intellectual property law were arrested on their premises again, the landlords would also face legal action. The shop managers were initially charged with selling counterfeit products carrying patented trademarks and would be sent along with evidence to police.

Mala Tangprasert from the private sector's committee for intellectual property prevention and suppression said the company in question was part of a major network importing counterfeit products and caused the government to lose income from related taxes and caused consumers harm from using bad-quality products.

... a bit has been published lately about Thailand's frustration at being persistently listed in the US Government's elite global list of most severe offenders of trademark and intellectual property laws... Thailand's presence on the list apparently affects other trade policy between the two nations.

... this minor bust is most likely a bit of a show to try to convince US trade inspectors that Thailand is serious about busting these guys, and to please take them off this embarrassing list.

... manipulating perceptions and concealing/denying reality is a burned-in Thai cultural value... an unannounced tour by US trade inspectors through any number of markets about Bangkok will disuade inspectors of any such illusions.

... corruption lies deep in the Thai bones... profoundly dependent on it and incapable of making it on their own, the corrupt cops benefitting from it are not going to go back to being cops, for Christ's sake!... c'mon, what do trade inspectors expect?

I am amazed how much bootleg stuff is sold, BUT how much of it is made in Thailand ?????

probably less than 10% of the electronics

and not half of the purses, shoes, clothes etc which are brought in from China......

The problem is that most trade inspectors, being American, are extremely clueless about the real goings on in SEA, and Thailand.

They don't bother trying to explore on their own, and they take the word of their hosts at face value ("why would they lie?"), so yeah, these demonstrations do invariably achieve the desired short term effect of a favorable paper being authored.

I used to discuss this with the head of the MPAA's international anti-piracy division, who assured me it was not necessary for me to check out local markets as he was personally assured by the then Prime Minister (Thaksin, at the time) that piracy and counterfeit movies had been "eradicated from Thailand's markets for good". When I questioned that statement, I did receive the "Why would he lie to me?" answer.

Of course, 30 minutes after checking into my hotel, I walked across the street to Panthip Plaza, bought a dozen "DVD movee" (all current), walked back, took pictures and screenshots of the videos and emailed them back.

The only response: "Very disappointing" (but at the same time, nothing further was being done about it.)

It was only one company that was busted at the different locations. Someone didn't get their payoff....lolol.

I was one of the very few that did not have to pay a boarding fee when I exported product by ship out of Thailand. My supplier could not believe that there was no cost to get my load on the ship right away....lolol.

To get product on a ship out of Thailand is considered one of the most corrupt ports in the world, and the cost can sometimes be outragous.

The USA inspectors are not clueless, they simply will not place the security band on shipments they have not personally inspected that are going to the USA.

There are so many containers stopped, and contents destroyed, coming into the USA, it would really supprise most people. About 1/3 of all products are rejected entry that haven't previously been inspected, and tagged.

There has never been a bad shipment of agricultural products entering the USA that were inspected, and tagged from outside the country.

The US inspectors are far from clueless...hahahahaha.

Film piracy likely to keep Thailand on US blacklist

Rampant illegal recording of films in theatres and a delay in the anti-camcording law are expected to keep Thailand on the US priority watch list of intellectual property violators for another year, officials say.

The law was drafted by the Commerce Ministry but is still being considered by the Council of State. It is unlikely to be passed by this government since an election is imminent, said Deputy Commerce Minister Alongkorn Ponlaboot.

The law will make any act of piracy a criminal case, not a civil offence, said Mr Alongkorn.

"Most criminals hire teenagers under 18 to record movies illegally, making it hard to bring their employers to court on a civil offence," he said.

"We are confident the new law will close the loopholes, making it difficult for violators and their bosses to evade punishment."

Mr Alongkorn has met with theatre owners, movie producers and involved parties to consider stiffer measures such as installing infrared cameras in theatres to monitor for piracy.

The Motion Picture Association, the powerful lobby group for the Hollywood film industry, alleges Thailand has the highest rate of camcorder piracy in Southeast Asia.

The MPA, together with the International Intellectual Property Alliance and the Cable & Satellite Broadcasting Association of Asia, have filed complaints with the US Trade Representative to ask it to keep Thailand on its list.

The priority watch list enables the US government to levy trade sanctions, though such threats are rarely carried out.

Washington will announce the list on April 30, said Pajchima Tanasanti, director-general of the Intellectual Property Department.

She said Thailand was previously in the "out-of-cycle review" of the USTR thanks to improvements in dealing with piracy. However, lobbying by American businesses and the delay in introducing new laws could put Thailand back on the list.

She said Thai police want three options to tackle piracy: the anti-camcording law, a way to control violations via the internet, and a law against building owners that allow the sale of pirated products.
