Quote: from CalEden on 8:43 pm on Mar. 11, 2006 True but for example a house you brought into the marriage, the appreciation that occurs during the marriage becomes community property. Given the increase in property values lately, that could be substantial. Any asset you bring into the marriage that increases in value during the marriage, the appreciation may become community property. That could even include your retirement.
As previously mentioned by thailife, you could set up a trust that owns all your assets to avoid this situation. For example, you could pay rent to the trust, which actually owns the home. You would be the sole beneficiary of the trust. You would probably have to spend some money on lawyer to do this.

Yes there's alot things that could be done. But most are probably beyond the realm of your average falang. Besides us Westerners are blinded by our romanticized image of wedded bliss. While the calculating Thai is f***ing your brains out for the future jackpot. If the little heads happy all is sweet. 5555!

CalEden, Have to agree with your POV, well stated. The joker who "interviewed" my TGF suggested that since we had been together for 4 years, perhaps the best way to get her a visa was to marry her. By this unwitting (and "helpful" comment), he inadvertantly played the deck of the embassy. So I immediately got up his ass about this being an abuse of the visa system. He realized he'd f***ed up big time, you could see it all over his face. But he simply shut up and refused to grant the visa. There is a standard in law, believe it's called the Rational Man's defense, i.e., a rational man would behaved behaved this way (e.g., I shot the home intruder because I thought my life was at risk), so therefore he must be aquitted. If this were applied to the case we presented to the embassy, the rational man would have stamped her passport without questions. Bottom line, it's just a lousy tourist visa, and they make it into this absurd process where the government becomes my parent, telling me I have to marry her before she can sight see in the States. The analogy is me having to marry my girlfriend before I take a flight from San Francisco to NYC. No one in the U.S. would ever stand for this sort of fascism. But it happens all day long, day after day in our U.S. embassies in Asia. I'm old enough to know the consequences of my actions and to take responsibility for them, whether that's being stupid enough to marry a TG I've known for 2 months, and watching her walk away with 50% of "our" accrued assets after 3 years, to the delight of the upcountry Isaan folks. So my message to my government: grow up. Frankly, I'll be spending my tourst dollars with my TGF in other countries, and will eventually be retiring in another country, as I see no value in the attitude my government takes about my personal life. The real loss is in real dollars to mom and pop shops in the U.S. who would have benefited from the business my TGF and I would have given them, if she were in the U.S. right now. Bottom line: This is how expats become expats.. - Balls

The reason for the difficulty in getting a visa for a TG is that US government is afraid that they may come to the US and engage in prostitution, or even become part of the worldwide sex “slavery” problem. There are many interest groups (such as the feminists) in the US who are watching the government very closely and are always making a big stink about this. If even one TG comes to the US and engages in prostitution, the shit will hit the fan for the person who approved the visa. So any TG who even looks like they “might have” ever accepted money for sex in the past will be denied a visa.

Looks like you Yanks have it much harder than us Aussies OR maybe I was just lucky. Applied for tourist visa for Thai G?F approved in 1 week,, she came she saw she liked,,, second visit visa applied for 4 months later, approved in 1 week. "Fiancee' visa applied for and approved after 4 months,, she was here on tourist visa so had to return to LOS to get Fiancee' visa. All went relatively smooth up to "Police check and clearance document"",,,,there she was in LOS after returning from Aus to collect Fiancee' visa and police tell her "take 1 month"" WTF. The poor gal burst out crying just afterward in a shop getting some more documents photo-copied,,, a lady in the shop said " did you put SOMETHING for the policemans Christmas BBQ inside your application???? AHHH penny dropped,, G/F returns to police head-quarters and adds a little something inside the application...VABOOM,, you come back in 1 hour it will be ready. All up the tourist visa was very easy,,, the fiancee' visa involves a lot and I mean a LOT of documentation and proof etc. smiles

Yo, on my lady's visa the embassy said to her, "you need to go get so and so document stating that you have never been married." When she called and told me that she must go get this document, I was like thats like asking me to go get a document that says "I dont beat my wife" but apparently its pretty common because the cops had one for her when she went to the station. cheers, atl

ATL - Yep, that's a fairly standard document. And probably easier to get than one that says you never beat your wife. Mel - Did not make that donation but was prepared to. The "Special Branch" took about a week to send out the clearance - the several months line I think is just a front counter line to induce those donations. We are nearing the end of the process here in Oz, tourist visas, fiancée visa, spouse visa, etc - the wife has just been granted her "temporary" resident visa - so two years from now she can apply for Australian citizenship if she wishes...it has cost $$$ and been an exercise in frustration. My advice for Oz (and this probably will apply elsewhere) is, if your TG is a former BG - omit that point, use her upcountry address as the home address and list her occupation as "home duties" or similar - and if questioned later "admit" to some part-time work selling coconuts on the roadside or whatever. From what I have read in this thread and elsewhere a tourist visa for Oz is much simpler to obtain than for the US (or England) - however it has only a maximum of 3 month duration from the date of arrival - basically for Oz you need only a letter of financial support from a sponsor and proof from the sponsor that he has the "means" to give that support. Add, Proof of the relationship (emails and photos together), valid passports, a couple of thousand baht and a week’s waiting time. Establish a reason that she will return home to Thailand, a child, to care for an ailing parent or cause the coconut stand can’t spare her for longer. One important point - My experience with Australian immigration is that they are more interested in establishing that the relationship between you and the girl is genuine rather than that she was working in a bar when you first met. Don't get fake references from jobs she has never had - these people are bureaucratic not stupid. Finally - Take the Thai approach - keep smiling and stay cool no matter what. If you don't play the game their way by their rules you will never get a visa. That's life. Enjoy.

It sounds like the Aussies have more of a civilized approach to issuing visitor visas. Good on the Aussies! The "relationship" is a problem in getting a US Visitor Visa for a single Thai girl. Being engaged or boyfriend/girlfriend is seen as a reason the visitor may not return home. Being a sponsor or offering financial support for the visitor indicates there is more to the relationship than just "friends". All seen by the US as detrimental and a compelling reason the visitor may not return home. I was instructed by my congressmans office not to mention anything about a relationship, it will result in denial.

Once again great differences in US / Aus policy. For the visit visa I defined and gave evidence of our ongoing relationship, plus my willingness and ability to support her. I also stated the visit visa was a part of that growing bond and for my g/f to assess if Australia was a suitable future home for her. Why the US figures it is not good is beyong my thinking,,, if you are open about it get the visa and she returns it is a extra +++ on your future fiancee" visa. Otherwise why the heck is she wanting to visit,, how can she finance it and etc etc,, gets more complicated. Anyway its not always smooth sailing with Aus immigratiojn either,, had a visit visa knocked back with my Vietnamese g/f in mid 90's,, but well understood their reasoning. Now having problems bringing wifes brother over,, they see no inducement for him to return to Thailand,, WTF he has two kids and all ALL his family there except his sister,,,but no convincing them,, I am taking it to the "appeals tribunal " deposit AUD$1,4000,, if you win you get your money back.... Smiles all round and best of luck getting any Beauracrat's to see reasonable and common sense.

Same same as Mel...I am just shaking my head trying to understand the US "logic" outlined by CalEden...you can't mention the relationship that is the backbone of the visit which she then has no credible reason to want to take or to be able to $$$ afford without the relationship???...WTF.....talk about a real life "Catch 22"?? Mel...you'd better mean $A1,400 not $A14,000 cause I may have a similar problem in the future and just choked on my lunch reading your last !!!
