I'm researching to find a solution to a small problem. A tg friend of mine in the US poked holes in my condom and neglected to take her birth control pills. I broke up with her soon after that and now Im a daddy to a little girl. Recently, the mom has hired a highly paid lawyer to take from my pocketbook and demands I pay for things including private schooling, college and monthly child support, etc., etc., etc.
If that wasnt interesting enough, she has lived in the US for 2 1/2 years and is still married to a guy that cohabitated with her for only 6 months. She admittedly married him only to come here for work. She contacts the guy when she needs him to sign documents to remain in the country and to take every social welfare handout. She pays no taxes and strips on the weekends to support herself.
I'm wondering if anyone else has dealt with marriage fraud in the US? Under section 8 U.S.C 1325, there appears to be a strong case against her and the husband of marriage fraud. Marriage fraud penalties include up to a $250,000.00 fine, 6 months in jails and in other cases, deportation.
I would rather not contact the Customs and Immigration office, but use this as a bargaining position of mine to mitigate my damages. From my experience, there are a lot of failed marriages between tgs and westerners in similar situations. Any advice is greatly appreciated.

If you use it as a negotiating position, you risk giving away your ace card -- and giving her every opportunity to fix the situation so you'd lose your advantage.
She is clearly trying to bleed you for all she can, while she is married to another guy (who should be legally supporting her and her child). If so, you should be freed from any support payment, anyway.
Personally, when the girl hires a high-priced lawyer to go after your hard earned savings, the time to play 'nice and polite' is over - a visit to Customs & Immigration is in order, and you most likely will need to provide a letter spelling out the situation and all you know.
Chances are, once immigration apprehends her, and is ready to deport her, and jail her 'husband', her lawyer will drop her like a bad habit.
If you are worried about your daughter, don't be - she is using the child as a bargaining chip, only. If you're serious, you can fight for, and get, custody, to prevent deportation. Otherwise, this may sound harsh, but it may be necessary to just let events run their course.

Don't kill the messenger formen but it sure sounds to me like you are screwed.
I am Australian and cannot comment on how the court system works in the US....but it is still a Western country. STAY AWAY if you can and as you suggest use the "threat" of the Customs and Immigration office to mitigate your damages.
However, I am guessing that she is now the mother of a US citizen so is unlikely to get thrown out of the country no matter what (would never happen in Oz anyway)
I have recently been re-dragged thru the farce that is the Family Court system in Australia and were you an Australian I would be telling you to expect the worst and then to multiply that several times.
Here in OZ the court would take the attitude that ANYTHING a piece of pond scum like you (nothing personal but being male there puts you at a huge disadvantage) would say about an angel like her is false and said only because you are trying to worm out of paying for your child (you cheap Charlie white trash son-of-a-bitch you!).
Also (and this is similar to my last reaming) since you have already admitted your "guilt" by offering the $800 - anything from now on would just be about finding out how much she "needs" and making sure that you pay it.
As I sit here and stare at the pocket calculator that tells me I received 5.26% of the proceeds of the sale of the former matrimonial home - and paid child support until our one child was 22 years of age - all with the blessing (read gun to my head) of the family court - well, whilst I wish you luck formen, I don't have any good news for you.
Insult to injury is that it is a TG doing this to you…. because getting treated the way you are is the reason that most of us went to Thailand in the first place.

I hope you are right…..justice for a male in a family dispute?....Only in the US….in Oz the family court can stop you leaving the country if they want to (for unpaid child support it is now standard practice) …..The Family court tell Immigration what to do not the other way around….

Its hard to say if she will get to stay here(due to the baby). The fact that she works in a bar is a major strike against her.

I think the baby is the husbands, not yours. What's the problem? Call imigration, be a hard ass. Only real issue is how you feel about having a kid that is your blood hanging out there. Not the kids fault. Legally, I think you can ditch the issue. Make sure your name is not on the birth certificate.

In the USA the girl (child) has rights of her own which are independent of whatever wrongs the mother may have incurred on.
Thus, when fighting the mother, the court will look at the rights of the child. When doing so, the court will not bother with US immigration law (believe you me, I have been there.. and yes, in the USA).
So, you can go for a very long protracted battle, or simply get a lawyer that will fight and consent to give her (the mother) child support for the amount that the scale (yes, there is a scale for this based on your annual income) says you should give her. FYI, in Florida it was about US$ 1,600 per month if you had a base salary of $200,000 per year (bonuses didn´t count).
There is no way you can avoid child support. Just agree from the outset to pay whatever your local scale says you should pay.
Now, when it comes to alimony for the mother, that is another matter. Just say NO and that should be the end of it.

This might sound a little stupid but.... you are 100% sure the baby's yours right?
How about the "hole in the condom" story? I mean, seems to me like a very easy way to scam guys adn if the courts let this one go then I see a lot of other ladies in need using this trick.
