Yes he was smoking a cigarette at that place which is illegal in US. The guy with Marijuana was caught in possession only not smoking but also illegal in the US. Technically speaking cigarette smoking is not illegal but Marijuana smoking is + possesion unless you have some medical disorder. Basically they both broke the law or got caught breaking it. I believe if he had been caught smoking a joint the fine would be higher than for possesion.
