I'm having some problems with my Landlord, including getting a copy of my Lease and having a neighbor who comes home at 3 or 4 am everynight and makes it impossible to sleep. Is there anyone who can help me with this? Do we have rights as Renters?

Hi -

You should be provided with a copy of your Lease. If you haven't got a Lease a Landlord cannot demand rent from you.

With regard to neighbours, they, or any owner of that property (if that too is being rented out) will have it in their Lease/Deeds etc that he, or any occupier of that property ) should... not do or suffer to be done on the Property anything which may be or become a nuisance or annoyance to the Landlord or the tenants or occupiers of any adjoining premises.....

or words to that effect.

I would suggest, have a quiet, but firm word, with your neighbours in the first instance. Follow this up with a polite letter (if they understand farang lingo). If this doesn't work you need to speak to the managing company/agent of your appartment.

I've dealt with this many times.

Make a complain with the owner and see if he's willing to take action.

Don't go talk with the offending neighbor (if he's Thai). It's unlikely this will solve anything, perhaps it will make it worst.

If the owner doesn't take action or he does, but doesn't resolve things, there's only two ways:

- Resort to terror.... buy a 1000 Watt system, put the speakers to the wall and blast a nice disco beat from 8 o'clock in the morning to 3 o'clock in the afternoon or similar times when he sleeps.
- Look for another apartment.

You rights go as far as the willingness of the owner.

Thanks for the suggestions. I agree that I don't want to try to talk to the neighbors. They are young Thais and I'm not sure how many people live there. I don't want them to get mad at me and make my life even more miserable...or worse.

The Office Management doesn't seem to care about this and will not do anything about it.

One more question that I would appreciate your feedback.....what happens if I just refuse to pay the rent?
I don't know what it says in my Lease, because I don't have a copy.

Normally they give you a fine and a new due date.

If you refuse to pay, more than likely to will evict you. Either verbally or with force.

In the last 25 years I lived in perhaps 20 different properties. In more than half of them, these problems occurred.

Remember, you're 'just' a foreigner living amongst Thai. They think it's their country and you have to abide by their rules.

I want to precede this by saying that I know absolutely nothing about Thai renter's rights -- but my guess would be that if you were to refuse to pay the rent, you would most likely find yourself evicted in short order.

I would suggest conducting all of your communications in writing, and first of all requesting and receiving a copy of your lease (did you not receive a copy when you initially signed your lease?). To eliminate any confusion, I would use a local attorney, so your request would be made in Thai and they could follow-up with the request to conclusion. You could, at the same time, point out your complaint, as well through your attorney, to the management.

Chances are that little will be done, and you would be better looking around for a better place, with more responsive management. That's what I would do.

Jazz,if you are a tenant from month to month you can terminate your lease by giving a month`s written notice to your Landlord.However,if you have committed yourself to a fixed term of say 6 or 12 months you can only bring the lease to an end if your Landlord has breached a term of the lease.I appreciate that you do not have a copy of the lease,but I do not think that your Landlord would be responsible for the noisy actions of your neighbours.If you simply abandon the premises with or without giving notice(if the lease is for a fixed term) you run the risk of forfeiting any bond moneys you have provided,and rendering yourself liable to pay the Landlord a sum equal to the rent for the balance of the unexpired term of the lease.Have you considered investing in earplugs?

Jazzy, do these young Thai neighbours of yours just "come home" at 3am or do they go on partying at home?

I found out that it is finally your heart to decide if some noise from other people bothers you or not.

Once upon a time there was a pimp living right above me and every night his chicks came in late in the night to report and cash in... high hells, gambling, shouting and all that... After a couple of month I was ready to shoot the guy... When he moved out (feet first... nah joking...) a young couple moved in who got twin babies short after... It was a challenge but most of the time I managed to respond to their noise with just a smile on my face...

Maybe you should actually talk to them, but make sure you do it the Thai way... start with a smile, avoid any kind of threat... As you know Thai are nice people in general, but many don't understand that noise could bother people...
