Back to the visa overstay: The problem is still the Thai law which has not changed yet: if your visa is not valid for whatever reason or you don't have one, then you are automatically deemed to be an illegal alien; and being an illegal alien gives the immigration police and other police the right to put you behind bars. The immigration officer at the border doesn't care too much whether you are an illegal alien as long as you can pay the overstay fee. If you don't have the money to pay and don't find one to help you out, then they will put you behind bars immediately - and I think they value one day in prison at 85 baht - so if you overstay for 10 days and you have no means to pay 2000 baht you will rot in jail for at least 3 weeks or as long until someone will pay for you.
And yes, police has the legal handle to put you behind bars if you don't carry your passport - but in most instances you get away if you can pay the officer. I have several colleagues who always carry at least a recent copy of their passports including a copy of their visa and immigration stamps.
99.9% of us are lucky and don't carry a passport or we overstay from time to time and still we don't have any problems - but if you belong to the other 0.1% you are in very deep sh_t indeed.

Don't take any sh_t in the metropolitan Bangkok area.
The cops are only trying to rob you.
Tell them to f_ck off and walk away.
If they pull the gun just rap them over the knuckles with your blade.
Seriously, the main problem Thai police have is to identify people they stop to question / harass on the street. Thais could show an ID card and the cops would be happy with who they are.
When stopping farangs they have an immediate language problem. If you produced anything they would accept it in 99.9% of cases as it makes their life a lot easier. Some low lifes may try to demand money before they return it so I would never show a document I was not happy to lose.
If you show a driving licence this wil normally satisfy them as you appear bona fide.
This applies in bangkok metropolitan area where it is my understanding (though I cannot identify the source) that you are not required to carry your passport.
If outside then you must carry it at all times.
If in Bangkok and black or Arab you would be well advised to carry it because at the moment you stand a good chance of being swept up in police operations.
