toxic, will of course comply with the rules. however, I do not think you can impose a 20k fine to the customer as it clearly states that this fine is for the managment of the bar.

This is just stupidity,, a sign does NOT cercumvent the law.
Sign at front of Mels house " anyone not smoking will be beaten up. ",, Does this protect me from charges of assault?,, NOPE.
Get a grasp people,, try very hard to think with logic.

If I was to be fined for smoking in Toxic,, I would offer to pay RTB's fine as well, so long as it was collected personally by ThaidUp or Daffy.

But now I am a :"member " of Toxic, it would seem I am immune to the smoking ban.

It's not that simple... If you enter a bar you enter a contract to live by the house rules..... If these are acknowledged by a sign or in other sort of writing, you might be liable... Compare the 'Cash only' in a store... There is no law written that the store has to accept your order if you don't want to live by that rule.

In the event you tell somebody to kill him or beat him up... that's specifically against the law...

I'm not quite sure why you press that point, as it has been established that there's no need for either Thaidup, or myself to reinforce such a rule.

Then again, you may also want to look up 'straw man', as you seem to prefer his company lately.

As the good Doctor pointed out, there is a difference between a contract that you enter into willingly (or, maybe I should say, 'freely'), and you threatening to break the law.

The law states that smoking in bars is forbidden, and punishable by a fine to the bar, as well as the perpetrator. You are, of course, free to break said law, but must be aware of the penalties. The penalty, as stated, is a 2,000 Baht fine to you. The bar is to be fined separately, to the tune of 20,000 Baht.

The sign posted by bar management, alerting you to their policy, constitutes a contract (written, even), and your remaining on the premises constitutes your agreeing to said contract. Your only defense may be a weak claim that you did not see said sign, or that the policy was not pointed out to you - but since you *are* aware of it, through this thread, all any potential inquiry need to do is subpoena this thread, or call any of us participants as witnesses. That's just splitting hairs, though -- you know as well as anyone, when it comes to it, you are Farang, and the bar is Thai, and thus you will be in the wrong - by default.

So, it is up to you to decide what is more important to you, and balance out the pros and cons of either position - and if you don't agree, to let your feet do the walking.

I am quite sure that if you flaunt your smoking at TOXIC, and for whatever reason the MiB should get wind of it, and you deliberately cause TOXIC to get fined 20,000 Baht repeatedly, you may find your dubious 'member' privileges revoked. Of course, that's up to RTB, it's his bar, after all - though you must really consume A LOT to make that worth it to TOXIC.

I maintain that CS pretty much spelled it out, clear enough for even an aborigine to understand.

Daffy,I wear a T-shirt stating" I am not responsible for fines imposed on smoking".That"sign" has the same (zero) legitimacy as the fore mentioned bar sign.

Why does the Law have a fine for the person AND a fine for the bar?? Think really hard now....

Yes, there are two possible breach's of the law,,one belongs to the person smoking and the other belongs to the bar. Each entity is seperate and seperately breaking the law. The individual involved would not likely be able to seek compensation from the bar, nor the bar from said individual.
Had the bar placed an ashtray in the vicinty of said person, then indeed I believe the individual would have a case for recompense.If the bar had attempted to stop the individual from breaching said law,through immediate and appropriate actions ( nota sign),then definately,said bar would have a very strong case NOT to recieve a fine ( they took appropriate and immediate actions toward compliance).

Either way my Toxic membership allows me smoking for the next 5 years,,so, who cares.
